Complex Tort Plaintive Litigation Suit Overview

Named bank defendants are in the business of origination and/or servicing of residential mortgages.
Following origination, the banks securitized the loans and sold them as investments.
The banks pooled the loans before sale as a means of inflating their value.
This evolved into a comprehensive scheme to inflate property values as a means of inflating their profits.
It is alleged that the banks were aware that these practices would create a real estate bubble, which would devastate their borrowers when it burst.
At the time the banks originated the loans, they concealed from the borrowers that their loans would be securitized and sold to unknown third parties.
Further, the banks concealed that their individual loans were part of a massive, fraudulent scheme to inflate property values.
The banks were under a duty to disclose these details to each borrower.
The bubble eventually burst, in 2008, and devastated homeowners.
The bank defendants thus systematically destroyed home values across [California, and] the nation.
Plaintiffs lost equity in their homes, suffered damage to their credit profiles, an incurred other damage.

Ian S. Berger

Ian S. Berger, Esq.

Mr. Berger practices in the areas of complex-mass tort litigation, including but not limited to real property transactions, eminent domain, foreclosure defense, and predatory lending. He is licensed in state of Florida, as well as the Federal Middle District of FL. Mr. Berger has participated in numerous trials and has been involved in complex litigation since 2006.

Prior to joining the firm, aside from his extensive property law background, Mr. Berger represented insurance companies specializing in insurance fraud investigations. In addition, he went on to represent the insured in multiple property claims against insurance companies, Florida motorists, and their treating physicians in Personal Injury Protection (PIP) claims (and other numerous claims) against insurance companies.

Mr. Berger is a member of The Florida Bar. He received his Bachelor of Science degree in Business Administration and Finance from the University of South Florida and received his Juris Doctorate from Nova Southeastern University in Miami, graduating Cum Laude from both institutions. While in law school, he participated in the Annual Chief Judge Conrad B Duberstein National Bankruptcy Memorial Moot Court Competition held at St. John's University. Mr. Berger was also a member of the Moot court Honor Society and took on the role of Chief Brief Writer during several National Competitions.

Mr. Berger lives in South Tampa with his wife of 10 years and his three sons.

Jeanne Lahiff, Esq.

Attorney Lahiff brings her wealth of experience and robust background in litigation to The Berger Law Group.

Attorney Lahiff graduated from the top third of her class from the University of Pennsylvania Law School and delivered the Best Brief in the Oral Competition (Atlantic Division) during the Jessup Moot Court Competition. She was a member of the Journal of International Law during law school and was a National Merit Scholar at Boston College, where she graduated magna cum laude. She also studied at the Universite Francois Rabelais in Tours, France, where she earned her DEUG II.

Attorney Lahiff clerked for Justice Gary S. Stein of the New Jersey Supreme Court before joining Paul, Weiss, Rifkind, Wharton, & Garrison of New York City as a Litigation Associate. Attorney Lahiff continued her litigation experience at McCarter & English in Newark, New Jersey. She has successfully argued motions in federal and state court, prepared briefs for federal and state actions, and has litigated 20 federal court trials. She has argued four appeals to the Second Circuit Court of Appeals, opposing motion for leave to appeal to the United States Supreme Court. Some of her noteworthy cases include: In re Merrill Lynch: investigation pursuant to the Martin Act into brokerages houses practices; In re Tobacco Products: nation-wide class action concerning tobacco products and Medicare/Medicaid; and In re Microsoft Antitrust matter: proceeding into predatory practices in the information industry.

Attorney Lahiff has also lent her expertise to CNA New York, New York as Vice President, LDG Enterprises in Philadelphia as Principal attorney, and has served as an Adjunct Professor at Seton Hall University School of Law.

Attorney Lahiff has published several legal articles and has provided many lectures on legal topics. She is licensed to practice law in New York state, the state of New Jersey, the Southern District Court of New York, The Eastern District Court of New York, the Northern District Court of New York, The Western District Court of New York, The United States District Court for the District of New Jersey, and the United States Court of Appeals, Second Circuit.
