Free Consultation

When you call for your free consultation, you will speak with a lawyer, not a sign up specialist, paralegal or legal assistant. Ask to speak with one of our partners, personal injury attorney Herbert W. Auger, with over 20 years experience as an NC Injury Attorney, or personal injury attorney Arlene P. Auger, with 18 years experience as a NC Accident Lawyer. As an added benefit to our practice, early in her career, Mrs. Auger worked at a law firm representing insurance carriers, giving our firm an insight at the inner workings of some of the major insurance carriers that we deal with on a daily basis.
We Accept Referrals From Other Attorneys

Our reputation for success and outstanding service is acknowledged by our peers, other lawyers who refer many of our clients to us. They trust us to treat their clients' personal injury needs with respect, while pursuing fair compensation with the utmost care and professionalism. We also work with referring/associating attorneys from North Carolina and other jurisdictions under NC State Bar Rule 1.5. If you are an attorney seeking assistance with a personal injury or wrongful death case, we are ready to help.
No Fee Until Recovery

When you hire Auger and Auger, there are no upfront costs or legal fees. We will advance all costs on your NC accident claim and will only charge a legal fee if we are successful in obtaining a settlement on your behalf. Since 1994, Auger & Auger has provided quality legal representation to plaintiffs in Charlotte and throughout NC in a range of personal injury matters, including:
Car and Auto Accidents:

We handle all aspects of your NC auto accident claim from filing your claim with the insurance company, helping you find qualified doctors, and understanding the insurance policy language and claim process. The auto insurance company's goal is to pay you as little as possible, and to do this they will try their best to get to you before you have the opportunity to consult with a lawyer. Don't make that mistake! Call now for your free consultation from an experienced NC Auto Accident Attorney.
Workers' Compensation Claims:

Often, the first instinct of an injured worker is simply to follow the instructions of their employer regarding their claim for workers' comp in Charlotte and surrounding areas. This can be a serious mistake! Your employer will likely do what is best for the company, and not necessarily what is best for you. The lawyers at Auger & Auger are experienced in handling all North Carolina and Charlotte workers' compensation claims and in making sure that you get the benefits that you are legally entitled to under the NC Workers' Compensation laws. Call now to speak with an experienced workers' compensation attorney.
Truck Accidents:

With truck accidents, in addition to the claims adjuster from the insurance company, you are now dealing with the trucking companies' supervisors and investigators who will rush to the scene of the crash, sometimes before the victims have left the scene. They are gathering up evidence to help with their defense and minimize their payout to you down the road. We are experienced in dealing with trucking companies and their experts. Call now to schedule a free consultation from one of our Charlotte, NC truck accident lawyers.
Motorcycle Accidents:

We have successfully represented many motorcycle accident victims in North Carolina. Injuries are often serious and are the result of the negligence of the driver of a car or truck who neglected to yield the right or keep a proper lookout. We will you find medical care and deal with the insurance company. Call now to speak to a NC lawyer experienced in motorcycle accidents and wrecks.
Wrongful Death Claims:

These are the most serious and sensitive types of claims for a lawyer to handle. It is imperative that you hire a firm that has the experience, dedication and knowledge to obtain compensation for the devastating injuries and death of a loved one. We handle Charlotte wrongful death claims and claims for the entire State of NC, regardless of whether your family member died as the result of a car accident, motorcycle accident, truck wreck, or on the job accident.

Auto Accident
North Carolina Car Accident Attorney
According to the CDC, car accident deaths cause $1.5 billion in costs each year in the state of North Carolina. $18 million of this goes to medical costs and $1.48 billion to work-loss costs. Individuals and families who have been in a car crash know that the financial losses can be staggering and the emotional losses impossible to measure.

At Auger & Auger, our experienced North Carolina auto accident attorneys know how much is at stake when you've been involved in a car wreck. The driver who caused your accident needs to be held responsible and we'll put our combined 35 years of litigation experience to work to make sure you are fully compensated for all of your economic and non-economic losses.
Auto Accident Cases in North Carolina

In North Carolina, fault rules apply to auto accidents. This means that when you are involved in a car wreck, you always have the right to make a claim against the driver who was at fault, or responsible, for causing the accident. The at-fault driver has to pay you compensation, called damages, which are typically paid by his or her liability automobile insurance policy.

To determine if a driver is at fault, it is important to consider whether the driver broke any safety rules. If so, that driver can be considered automatically liable for an accident that resulted from his or her violation. A driver may also be considered at fault for an auto accident if he or she behaved more carelessly than any reasonable driver would have. Resolving the liability issues is essential to assessing whether you can make an auto accident claim.

An experienced North Carolina auto accident lawyer at Auger & Auger can help you gather the evidence you need in order to prove who was to blame for your wreck. The sooner you contact us, the stronger the case we can build for you and the better your chances of getting the money you deserve. You should also learn what to do after a car accident so you can be prepared in case you are ever involved in a crash.
Types of Vehicle Accidents in North Carolina

Vehicle accidents can happen any time, anywhere and to anyone. Some of the most common types of vehicle accidents include:

Head-On Collisions
Tailgating and Chain Reaction Car Accidents
Rear-End Collisions
Intersection Collisions
Bicycles Hit By Cars

Each different type of auto accident brings with it its own complications and risks. For example, chain reaction auto accidents involve multiple cars and it can be hard to determine which driver was to blame. Hit-and-runs can leave you without a defendant to make a claim against and forced to seek coverage from your own uninsured/underinsured motorist protection if your policy covers these types of damages.

A North Carolina auto accident lawyer at Auger & Auger will assist you in understanding the complexities of your case. We will sit down with you to review your situation at a free no-obligation consultation and help you understand your legal rights. We will provide personal attention and dedicated representation throughout every step if we represent you. We are always prepared to answer your NC auto accident FAQs so you will always be up-to-date on what is going on with your case.

If you were involved in a collision with a truck, refer to our North Carolina truck accident resource page.
Compensation from a Car Accident Claim

The compensation in a car accident case varies depending upon how badly you are hurt. You should be able to recover damages to pay for:

Medical Treatment
Medical Bills
Lost Wages
Property Damage

You should also recover compensation for pain and suffering and emotional distress. In tragic fatal car wrecks, wrongful death damages are also available to the family.

Damages can be obtained through negotiating a settlement with the insurer or in court. Insurance companies are never on your side and dealing with the insurance company can be very stressful. You should always have a North Carolina auto accident attorney looking out for you and negotiating for you.

Personal Injury
North Carolina Personal Injury Lawyers
Those who suffer injury because of negligence or wrongdoing have certain rights under the laws of North Carolina. The experienced and dedicated Charlotte personal injury lawyers at Auger & Auger have been helping injured victims protect their rights since 1994. With a combined 35 years of litigation experience, our attorneys are never afraid to take on the tough personal injury cases to fight for you.

Personal injury laws in North Carolina allow injured victims to file civil lawsuits against people, companies or even government entities whose acts or omissions cause harm. Cases can be resolved in court or through a settlement negotiation, but no matter what, you should have a knowledgeable legal advocate representing you.
When Do You Have a Personal Injury Claim?

Under the laws in North Carolina, individuals and companies owe certain duties to each other. For example, day care centers are obligated to provide adequate care and reasonable supervision to their young charges. Drivers have to follow all driving safety laws and have to make sure they don't take unreasonable risks.

Any time a duty is violated, a personal injury claim can potentially arise. For example, an injured victim could file a personal injury lawsuit if he or she was hurt in the following situations:

Auto accidents
Truck accidents
Motorcycle accidents
Bicycle accidents
Pedestrian accidents
Dog bites
Wrongful death

In these or other situations, the most important consideration is determining whether someone was negligent. A person who broke a safety rule or who was unreasonably careless can be considered negligent and in breach of a legal duty. This gives rise to a personal injury claim.
Types of Personal Injuries

A Charlotte personal injury attorney at Auger & Auger can represent you in any type of personal injury claim to help you obtain compensation. The amount of money you can recover after you have been hurt varies depending on how badly you were injured. Three of the most common injury types include:

Head injuries, including traumatic brain injury / TBI
Back injuries, including spinal cord injuries
Neck injuries / whiplash

Other injuries include burns, broken bones, amputations and any other physical or mental damage you suffer as a result of an accident.
Compensation in a Personal Injury Case

The severity of your injuries dictates how much money you can recover in a Charlotte accident because compensation is intended to "make you whole." You should be compensated for:

All medical costs/bills associated with your injury
Lost income or lost earning potential if your injury prevents you from working or forces you to take time off
Pain and suffering damages
Emotional distress damages

Sometimes, the victim is killed in a personal injury case. When this happens, wrongful death damages are also available to surviving family members, including damages for loss of companionship.

The amount of compensation should always cover these losses, whether you settle by negotiating with an insurance company to receive payment or whether you go to court and a jury decides how much you deserve. An experienced Charlotte injury attorney will negotiate on your behalf or fight to maximize your compensation at trial.

Hunter Gillespie

"I have always had a passion for helping others. It was this passion along with a desire to fight for those in need that drove me toward the practice of law."

I was born in Pittsburgh, Pennsylvania and moved to the Charlotte area in 1995. I received my undergraduate degree from the North Carolina State University where I graduated Magna Cum Laude with a degree in Business Management in 2008. After working for a year I decided to follow my dream of practicing law and went on to attend the Norman Adrian Wiggins School of Law at Campbell University. While in law school, I was a semi-finalist in the Richard A. Lord Moot Court Competition and gained practical experience working for a personal injury firm in Raleigh, North Carolina. Upon obtaining my Juris Doctorate in 2012, I made the decision to return to Charlotte where I joined Auger & Auger as an associate attorney in the fall of 2012.

I believe in helping others to protect their rights through hard work and aggressive representation. It is my goal to help my clients achieve the best possible outcome in any situation.

In my spare time I am an avid sports fan and enjoy running and cooking.
