The New Bankruptcy Law, The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, went into effect on 10/17/2005, containing changes that greatly affect your bankruptcy filing options. Under the old rules, most filers could choose the type of bankruptcy that seemed best for them and most chose Chapter 7 (liquidation) over Chapter 13 (repayment). The new law is prohibiting some filers with higher incomes from using Chapter 7; they will instead have to repay at least some of their debt under Chapter 13. All debtors will have to receive credit counseling before they can file a bankruptcy case and additional counseling on budgeting and debt management before their debts can be eliminated. And, because the law imposes new requirements on lawyers, it may be tougher to find an attorney to represent you in a bankruptcy case.

For almost two decades, our firm has been providing quality legal services to businesses of all types and sizes. Flowing from those business clients, is a need for other areas of practice. As a result, we currently are heavily engaged in providing legal services in the areas of criminal law, divorce and family law, bankruptcy law, estate planning, litigation, as well business legal services.

What experience or education distinguishes your lawyers from others

A major factor distinguishing us from many other law firms is that most of our attorneys have owned businesses unrelated to law. This brings a unique prospective to the practicing attorney in that each of us are able to empathize with each client because each of our attorneys has life experiences similar to those of our clients because we set on the other side of our desk having many of the thoughts that our clients have when they first meet us.

Vincent Carosella, Jr. is an experienced business attorney licensed to practice law in Pennsylvania and New Jersey. His areas of concentration are business and corporate law as well as commercial and residential real estate, zoning, wills and trusts. Prior to forming the Law Firm of Carosella & Associates, Mr. Carosella was a member of the real estate and commercial lending department at Stradley, Ronon, Stevens & Young, one of Philadelphia's most prestigious law firms.

Mr. Carosella has a wealth of business knowledge and hands-on experience as he has owned and operated many large companies, including a solid waste company in Philadelphia, an environmental assessment company in Delaware County and a heavy truck repair company in Philadelphia. Having practiced at a large Philadelphia law firm, Mr. Carosella brings big firm experience to his clients at the fee level of a smaller firm.

Gary Thompson, Esquire

Gary E. Thompson, Esquire has been in private practice for over 25 years, handling a variety of cases with a specific concentration in bankruptcy, commercial litigation and collection law. Gary practices in Pennsylvania and NJ, in both State and Federal Courts. Given his expertise in the bankruptcy and collection fields, he brings a unique perspective to this area of law because of his ability to see cases from both the debtor and creditor point of view. Christopher Amentas, Esquire

Christopher J. Amentas specializes in litigation with a particular emphasis on commercial, construction, personal injury, zoning/land use and municipal matters. In addition to his litigation background, Mr. Amentas is a former Chairman of the Board of Supervisors of East Fallowfield Township in Chester County. As a Supervisor, Mr. Amentas was generally responsible for Township governance including supervision of public improvements, works and other construction projects. Mr. Amentas' position as a Supervisor provided him with a unique perspective on how zoning and land use ordinances, procedures and laws impact construction and municipal clients on a local and statewide level. Similarly, as a former elected official Mr. Amentas is uniquely situated to navigate quasi-judicial, political and legislative processes in order to advance his clients' interests.
