Fact: Lawsuits are unavoidable in business.
FACT: Lawsuits are unavoidable in business. No matter how hard we try to stay in front of problems and have ironclad contracts, Bellatrix PC's clients sometimes have to sue to vindicate their rights with customers, vendors, business partners, employees, competitors and third parties who violate their contract and property rights or commit frauds or torts against them. Business is not always neat and relationships with others sometimes end badly.

And, even for the most litigation-shy business, lawsuits are unavoidable because no matter how careful you are, your business will eventually get sued or seriously threatened with a lawsuit. Businesses must budget for legal expenses. Legal services are a necessary part of protecting and growing your business.

Consider the following:

On an average year, approximately 16 million civil lawsuits are filed in the United States. That is one lawsuit every two seconds; or one lawsuit for every 16 adults in the country per year.

About one thirteenth of all civil lawsuits in the United States, or about 1.2 million civil lawsuits, are filed in California every year. That's 4,615 lawsuits filed every single business day, if averaged. That's one lawsuit for every 32 people (man, woman and child) in the state.

About 215,000 civil lawsuits are filed in Missouri each year. That's one lawsuit for every 28 people (man, woman and child) in the state.

39% of California companies had a class action brought against them in 2009.

32% of California businesses have had more than 20 lawsuits commenced against them in any given year.

As defendants, you have no choice but to engage in the litigation process in at least some manner or another. The goal of Bellatrix PC as legal counselors to our clients is to avoid most lawsuits, and to be well-positioned when they become necessary.

Bellatrix PC offers individually quoted fee packages for litigation matters at all stages, including flat-fees, milestone fees and traditional hourly fees with retainers. The expense of a lawsuit depends on the stage and complexity of the matter. Frequently, litigation matters take a year or more to resolve.

How did your firm decide on the primary area of practice(s)?

Our founder's background is in complex civil litigation and employment law advice. Then, after she became a business owner and entrepreneur herself, she found a niche helping other business owners and advises in both routine and complicated matters. The firm has always narrowly focused on cutting-edge and sophisticated business counsel and defensive litigation because it is what we do best.

What is your firm's point of view regarding clients educating themselves on legal issues?

We happily aid clients in educating themselves on the law. Their improved sophistication helps the attorney and client discuss business needs and make better decisions.

Is your firm willing to review documents prepared by clients?

We regularly review documents prepared by clients. There are times when the client taking the lead can be very helpful based on their understanding of the situation.

Is your firm willing to coach clients who want to represent themselves?

Only with respect to Small Claims matters and in some business negotiations. In unlimited civil litigations (particularly in the areas of law and disputes we handle), self-representation can be disastrous and is not recommended.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

Relatively frequently. Most cases settle, and mediation in particular can be a very effective way to get there. We always consider alternative ways to resolve a problem when disputes arise.

Does your firm provide pro bono legal services or otherwise participate in your community?

The firm encourages all its employees to support through volunteerism local charities and causes. Although the firm has a strong sense of community service as part of its culture, it does not accept solicitations for pro bono legal representation through online sites like NOLO.

What are your firm's strengths and style?

Bellatrix PC interviews prospective clients before accepting them to make sure that they are a good fit for the firm. This is because we develop strong relationships with our clients. We strive to holistically understand their businesses and their short and long term needs, to provide them with the best solutions now for prosperity tomorrow. Our clients are also our friends, our colleagues and our inspiration. Bellatrix PC's client collaboration, sophistication and personality is why most of our new clients come to us by referral from our old clients.

Is your firm willing to help a client with one discrete part of a case, without taking on the whole case?

Occasionally, but this is frequently not a good value. We usually cannot do our best work without understanding the situation deeply.

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

We staff legal matters at the beginning depending on the type of matter. The lawyer from the beginning is the lawyer who stays with the client throughout the matter. Usually a senior lawyer handles the case with the assistance of paralegals and junior lawyers for cheaper preparation of more routine legal documents and discovery. It is important for the handling attorneys to work with all the evidence and litigation, so usually matters are staffed "lean" so that the attorneys are experts in the case from beginning to end.

Alicia I. Dearn

Alicia I. Dearn is the Founder, CEO and Managing Attorney of Bellatrix PC, a business and enterprise facing law firm with offices in Saint Louis, Missouri and San Diego, California. Ms. Dearn handles civil matters in all areas of business law and employment and labor law. Acting as an outsourced general counsel for many of her clients, Ms. Dearn takes pride in becoming a part of the internal business team. Her clients come from a diverse portfolio of industries: manufacturing, restaurants, political, retail, software and staffing organizations.

In 2012, Ms. Dearn served as General Counsel to Governor Gary Johnson's Libertarian campaign for U.S. Presidency. Most notably, she successfully defended multiple legal challenges to Gov. Johnson's placement on ballots. This success earned Ms. Dearn a fearless reputation for victoriously going up against some of the nation's top-ranked election law attorneys in multiple eleventh-hour state electoral proceedings simultaneously. She also serves on the Libertarian National Committee's Ballot Access and Litigation Committee.

With a lengthy resume in both federal and state courts, Ms. Dearn's litigation practice is multi-jurisdictional, sophisticated and full-service. She handles trials, appeals, complex litigation matters and class actions.

Prior to starting her own firm in 2008, Ms. Dearn practiced in general civil and employment law litigation with two of the country's most prestigious firms, Paul Hastings Janofsky and Walker and Pillsbury Winthrop Shaw Pittman. During her tenure with Paul Hastings, she was one of two lead associates handling the wage-hour class action Hohnbaum v. Brinker International, Inc. on behalf of the employer, Brinker International (Chili's restaurants). The California Supreme Court in a seminal decision ultimately upheld class certification and wage rulings in favor of the employer.

Ms. Dearn is admitted to practice before the United States Supreme Court and in California and Missouri.

In June 2013, Ms. Alicia I. Dearn was named semi-finalist for San Diego's Top Attorney award in Business Litigation. In both 2007 and 2008, Ms. Dearn was awarded pro bono service awards by the California Supreme Court.

Ross Poole

Mr. Poole is a rising star in California complex civil litigation and trials. Receiving his Juris Doctor in 2012 from Penn State University, Ross joined Bellatrix PC as a Litigation Associate in December 2012. Showing skill and legal aptitude equal to practitioners with many more years experience, Mr. Poole has already second chaired a five-day civil trial and been a key player on the defense team in several six and seven figure complex cases. When Ross is on their matters, clients get a real "bang for their buck" in terms of capability, professionalism and aggressiveness.

Raised in a family where members owned small businesses or worked in the competitive aerospace industry, his passion is in business law and business litigation, specifically business defense. Working for his father's construction company in college, he learned early about management issues faced by business owners, and uses this experience to better understand Bellatrix clients' problems. Having the charming and tenacious personality necessary for a natural trial lawyer, Ross always goes the extra mile to not only win cases, but to provide Bellatrix clients' with the Peace of Mind they seek.

When Ross is not busy helping Bellatrix clients, he enjoys spending time at Disneyland with his girlfriend Ashley, in his native Orange County.
