How did your firm decide on the primary area of practice(s)?

The Matheson Law Office's Owner and Principal Attorney M. Moseley Matheson has always enjoyed the practice of Criminal Defense. From his days as an intern with the Durham County Public Defender's Office as well as when he was sworn in as a Harnett County Assistant District Attorney, Attorney Matheson has always enjoyed the challenge of criminal cases and trials. With his work with the Public Defender's Office, as well as the A.C.L.U., Attorney Matheson recognized that everyone deserves a quality legal defense to criminal charges and he has set out to provide that to the clients of the Matheson Law Office, Pllc.

What experience or education distinguishes your lawyers from others

Attorney Matheson is a former Assistant District Attorney in Harnett County. Mr. Matheson handled many different kinds of cases from minor traffic charges, to property crimes, drug crimes, DWI's and probation violations. He received extensive experience in the way the State approaches their job of prosecuting those charged with violating North Carolina Laws.

Additionally, Attorney Matheson spend a substantial amount of time learning from the very talented Criminal Defense Bar employed at the Durham County Public Defender's Office. Mr. Matheson took advantage of this internship during law school to learn from those who make a living Defending those who can not afford private attorneys.

Mr. Matheson also interned with the A.C.L.U. Capital Punishment Project, where he spent countless hours researching various death-penalty cases. Mr. Matheson's research was utilized by staff attorneys at the A.C.L.U. to coordinate their efforts regarding Capital Crimes.

What distinguishes your law firm from others?

Aside from utilizing the experience Attorney Matheson gained as a former Assistant District Attorney, the Matheson Law Office prides itself on the level of care and personal attention their clients receive. It is very common for us to hear horror stories about clients previous experience dealing with an attorney. Attorney Matheson insists that all of his clients are treated with the respect they deserve and ensures that all of their legal needs are met. It is very common for Mr. Matheson to take calls from his clients on the weekends or evenings, as well as traveling to the Wake County Jail when a client or potential client has been arrested. Additionally, the Matheson Law Office works to make sure that their clients time is not needlessly wasted waiting around in court for their attorney to show up. Attorney Matheson insists on being in court on time. For the rare occasion where Attorney Matheson is unavailable right away, the client will be notified and, where necessary, another attorney will handle continuing the case until Mr. Matheson can address the case personally.

M. Moseley Matheson

Attorney M. Moseley Matheson graduated with honors from the North Carolina Central University School of Law. During his tenure in law school, he developed a passion for criminal defense and helping those in need. Because of this passion he sought out opportunities to cultivate his knowledge of North Carolina Traffic law, North Carolina Criminal law, and North Carolina DUI Defense.

Mr. Matheson began his legal career while still in law school as a Law Clerk at the Law Office of D. Hardison Wood. While assisting the firm in their civil case load, he helped establish a criminal defense area of practice. From developing criminal forms and processes, to handling client intakes and files, to keeping the criminal defense attorney abreast of upcoming cases, Mr. Matheson assisted in all facets of this new area of practice for the firm.

After finishing his clerkship, Mr. Matheson went on to intern at the American Civil Liberties Union on their Capital Punishment Project. During this time, Mr. Matheson was assigned capital punishment cases to research. Staff attorneys would utilize his research results in their work for the A.C.L.U. This research required establishing a thorough understanding, not only of the cases themselves, but also of the applicable capital punishment laws for each case and how they were being applied during trial.

While at the A.C.L.U., Mr. Matheson also interned with the Durham County Public Defender’s Office. In addition to assisting his supervising attorney in his caseload, Mr. Matheson was assigned his own indigent clients to represent under the North Carolina State Bar’s 3rd year practice rule. Mr. Matheson handled many misdemeanor cases in Durham Traffic, District, and People’s court. In addition, he won his first trial representing a client who was charged with prostitution. After the presentation of the State’s evidence, attorney Matheson’s cross examination tore such holes in the testimony of the arresting officer, the judge dismissed the charge without Mr. Matheson having to present any evidence at all. For his time at the A.C.L.U. as well as the Public Defender’s office, the North Carolina Bar Association gave him a Certificate of Recognition for the Pro Bono work he did volunteering for these two organizations.

After graduating from law school and passing the North Carolina State Bar Exam, Attorney Matheson went on to volunteer at the Harnett County District Attorney’s Office. While at the District Attorney’s Office, he was sworn in as an Assistant District Attorney for Harnett County. Attorney Matheson routinely handled Harnett County’s District court by calling calendar, negotiating pleas with defense attorneys and pro se defendants, as well as trying cases. Mr. Matheson had great success prosecuting cases at trial, including obtaining convictions for Assault, Injury to Personal Property, traffic cases and parole violations. Mr. Matheson also took this opportunity to observe as many trials as possible in order to learn successful tactics in North Carolina Criminal Defense and North Carolina Traffic Defense. Lastly, Mr. Matheson assisted in the prosecution of multiple North Carolina DWI charges, including being a second chair in a jury trial and the sole prosecutor in a DWI bench trial.

Since leaving the District Attorney’s office, Mr. Matheson has returned to his passion; criminal defense work. As a Criminal Lawyer Durham and Raleigh Criminal Lawyer, Mr. Matheson has handled many different types of traffic and criminal cases; from bounced checks and minor traffic infractions to DWI’s, misdemeanors and felonies. Recently, he successfully plead down a class E felony of Second Degree Kidnapping to a class 1 misdemeanor.

Mr. Matheson is licensed and admitted to practice in all North Carolina District and Superior Courts as well as Federal Courts in the Eastern District of North Carolina. He is an Active Member of: The North Carolina State Bar, North Carolina Bar Association, Wake County Bar Association, and the 10th Judicial District Bar Association.

In his spare time, Mr. Matheson enjoys spending time with his wife and two rescue dogs at their home in Holly Springs. He’s an avid outdoorsman who also enjoys auto restoration and fabrication. Additionally, attorney Matheson volunteers his time with the Capital Area Teen Court Program, the North Carolina Advocates for Justice – Moot Court Competition and the Lunch-with-a-Lawyer Program. Mr. Matheson is also a proud member of the St. Andrew’s Society of North Carolina (a Scottish Heritage group).
