It's difficult to pick two remarkable examples involving consumer bankruptcy. The process is very similar in every case. What varies is whether or not a particular individual qualifies for a Chapter 7 bankruptcy or if they have to file a Chapter 13 Bankruptcy. A Chapter 7 bankruptcy will allow a debtor to discharge most, if not all of his/her debts. A Chapter 13 allows a debtor to catch up on a mortgage or car note and possibly repay some other debts. I have been fortunate enough to meet many people from different walks of life. Most people buy into the myth that only the poorest of the poor can file a bankruptcy. In fact, I have helped people with little to no income through bankruptcy as well as people with six-figure incomes.

While almost all bankruptcy cases are similar, we believe that every client is different and should receive individualized care. At the Law Office of Robert I. Masten, Jr., Esq., LLC, we are committed to giving every client the amount of attention they feel they deserve while providing excellent bankruptcy services. You will not be just another number to this firm.

What is your firm's point of view regarding clients educating themselves on legal issues?

Clients should be well educated on the issues that they face in any bankruptcy and how those issues can be solved. Just because a client engages an attorney does not mean that they should not participate in their case. Lawyer-client interaction and cooperation is key to a successful bankruptcy.

Is your firm willing to review documents prepared by clients?

While bankruptcy is a fairly straight-forward process, it is also a difficult and often times sophisticated process that lay people find difficult to get though by themselves. I do not encourage my clients to prepare their own legal documents. Reviewing and/or revising client drafted documents for the client to use without attorney representation is questionable ethically and is frowned upon by the local legal community. Therefore, the firm will not review, revise, or draft documents for a debtor to use on their own behalf.

Is your firm willing to coach clients who want to represent themselves?
