Firm Focus

Firm History
Our firm was founded in 1985 by an injured railroad worker, who then attended law school himself and he became the founding attorney of our firm. Our injury law firm has expanded to representation in all areas of personal injury law including accidental injuries, disease and wrongful death cases arising in Virginia, the Carolinas, or throughout the eastern United States.

Example Cases
1. Our firm, along with co-counsel, obtained a $46 million jury verdict for a gas station worker who suffered a mild traumatic brain injury after a train accident. At the time this verdict was rendered, it was the largest traumatic brain injury verdict in Virginia history. With interest, the total award was $60 million.
2. Richard N. Shapiro obtained an $8.6 million jury verdict for a railroad worker who lost his life after being diagnosed with lung cancer. Mr. Shapiro's client was exposed to diesel exhaust fumes, radioactive scrap, and other toxic carcinogens while working for the railroad. Rick devoted more than four years to this case in order to get some semblance of justice for his client and the client's beneficiary and the case was appealed.
3. Randy Appleton, as co-counsel, secured a $3.5 settlement for a 5-year-old child whose father was wrongfully killed in a Virginia truck accident.
4. Jim Lewis obtained a $2.3 million jury verdict in a medical malpractice case involving a child who suffered shoulder dystocia due to a nurse-midwife's negligence.
What is your firm's point of view regarding clients educating themselves on legal issues?
Our firm writes injury law articles and blog posts every week of the year, and has posted hundreds of personal injury law articles on Virginia Beach Injuryboard, Norfolk Injuryboard, and Northeast North Carolina Injuryboard blog platforms. All of our attorneys serve as lecturers to other lawyers on personal injury and evidence law not only within Virginia, but at national lawyer organizations including the American Association for Justice.
Are your attorneys willing to review documents prepared by clients?
We will review papers in order to give a free consultation to clients as long as this relates to personal injury law.
Are your attorneys willing to coach clients who want to represent themselves?
In the field of personal injury law, if we do not believe a case requires a lawyer we will tell that to a potential client and will not accept their case for those reasons. We try not to give legal advice to clients that are going to represent themselves as it can be an ethical dilemma.
Are your attorneys willing to help a client with one discrete part of a case, without taking on the whole case?
If we don't think a client needs an attorney we will simply tell them that.
What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?
Our attorneys often work in teams, and many of our cases have a primary attorney. But if a trial is required, a second attorney assists at no additional cost to our client. We are very clear with clients so that they understand who their attorney is on a case.
How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?
Our firm has been using mediation for over a decade, and we excel at preparing mediation presentations, charts, graphics, PowerPoint shows, videotaped interviews and whatever is necessary to help win a case.

Our firm will handle cases for no fee when a client is indigent, and this only occurs in infrequent circumstances because there are no fees to a client unless we recover unlike other areas of the law.

Typical Retainer
All of our retainer agreements are contingency fees for personal injury cases, meaning no upfront fees and an attorney fee only if we recover for you. The fee will vary depending upon the type of case and this is discussed with a potential client so there are no misunderstandings. Please consult with our lawyers for any questions in this regard. We have a "No Fee if No Recovery" pledge right on our firm website, and we list numerous reasons our clients choose us as well.
