Example Cases

Barbara Ann Stamper v. Steven G. Hyden and The Standard Fire Insurance Co., Ky. App., 334 S.W.3d 120 (Feb. 18, 2011) that was decided by the Kentucky Court of Appeals this year that established new law in Kentucky for uninsured motorist insurance coverage by declaring that an accident for purposes of determining uninsured motorists insurance was to be viewed from the standpoint of the policy holder, i.e., if the crash was not the plan, intent, or motive of the policy holder then the incident was an accident triggering coverage for purposes of uninsured motorists insurance.
