Our firm focuses on litigation (lawsuits) related to real estate and business.

Real estate litigation can involve issues such as property boundaries and easements, or acts or omissions which have affected the state of title.

Business litigation can include investment fraud, partnership dissolution, vendor disputes and contractual issues.

We also handle probate litigation, such as disputes between trust beneficiaries.

Example Cases

Case # 1: Client Sellers sold house to Buyers with bank financing and seller financing (i.e., Sellers "took back a note.") Buyers asked Sellers not to record deed of trust for a while, so Buyers could get financing for improvements. Unfortunately, Sellers agreed. Buyers refinanced several times, defaulted on note and disappeared.

Clients came to us. We found other property owned by Buyers which was on the market. We got the Court to issue an injunction to allow the sale of the other property, but to hold the proceeds in escrow until our lawsuit was resolved. Buyers settled the case with our clients.

Case # 2: Client worked for Boss for many years. Boss told Client "I want to leave you my house." Boss and Client went to Title Company to deed house from Boss to Boss and Client, so Client would inherit. When Boss died, Client found out that Title Company used incorrect vesting language in deed, and Client now co-owned house with Boss' estate.

Client came to us. Title Company refused to acknowledge or correct mistake. We sued Title Company, and settled with Boss' estate. Mediation failed. We filed motion, won, filed another motion, Title Company settled with Client while second motion pending.

Case # 3: Client received "cold call" from "investment broker" touting "oil spot market" as "safe investment." Client lent money to company. Never repaid, letters ignored, "big deal" that would "pay everyone off" always just around the next corner.

Client came to us. Borrower — out of state company with no assets — employed standard disclaimer in loan contract "Lender is aware of the risk ..." Broker did not have a license to sell "securities," and a loan is a "security." We sued Broker, filed Motion for Summary Judgment, case settled at mediation with motion pending.

What is your firm's point of view regarding clients educating themselves on legal issues?

We keep clients apprised of key developments, and send clients copies of pleadings filed both by us and by opposing counsel, so that clients can make informed decisions.

Are your attorneys willing to review documents prepared by clients?

It is usually a better use of client money and attorney time for a lawyer to prepare a document.

Are your attorneys willing to coach clients who want to represent themselves?

No.

Are your attorneys willing to help a client with one discrete part of a case, without taking on the whole case?

This may be advisable, for example, if a particular act or occurrence has resulted in both the filing of a civil case and criminal charges. If so, our attorneys might represent the client in the civil matter, and consult with the attorney representing the client in the criminal case.

What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?

We do our best to provide cost-effective representation.
