Example Cases

1. Hip Fracture in Nursing Home Fall. A patient, who had been admitted to a nursing facility for rehabilitation, fell when a nursing assistant was lifting her. She fractured her hip, had surgical repair with plates and screws and suffered post-surgical infections. Mr. Katter negotiated a $370,000 settlement after mediation and on the eve of trial.

2. An elderly, independent, man was admitted to a nursing home for short-term rehabilitation. The nursing home noted that he was at high risk for falls and required constant supervision and assistance. Contrary to its own directions, and New York State law, the nursing home failed to supervise or assist the man. He fell, struck his head and suffered major injuries. I represented his grandniece who sued the nursing home operators on her granduncle's behalf. We recovered a six figure substantial settlement based on the home's negligence in caring for her granduncle.

What is your firm's point of view regarding clients educating themselves on legal issues?

It is my job to make my clients aware of their rights under the law. They should rely on me as their attorney for guidance but they are the ultimate decider. They are welcome to learn about the law on their own.

Are your attorneys willing to review documents prepared by clients?

Generally, during a lawsuit, our firm will draft the documents with our client's input and approval.

Are your attorneys willing to coach clients who want to represent themselves?

Nursing home abuse and personal injury lawsuits are strongly defended against and fought by law firms hired by insurance companies. We do not recommend that clients represent themselves in these types of claims.

Are your attorneys willing to help a client with one discrete part of a case, without taking on the whole case?

My firm retainer provides that I will represent the client from the time their claim is made until it is resolved through trial or settlement.

What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?

We have honed our firm's team efforts to most efficiently and effectively deliver legal services. Each team member works on parts of the case where their efforts will deliver the most results.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

We use mediation, arbitration, or collaborative law as often as necessary to obtain the highest financial recovery permitted under the law for our clients.

Does your firm provide pro bono legal services or otherwise participate in your community?

I have been the am the pro bono counsel for my synagogue since 2006. I was a volunteer arbitrator in the NYC Small Claims Court for ten years. Also, I volunteered in bar association pro-bono consumer walk-in clinics and bankruptcy programs.
