Firm History

After working for a high-volume bankruptcy, loan modification and personal injury law firm in Suffolk County I decided to go off on my own and establish the Law Office of John P. Brooke in January 2010.

Example Cases

In a recent case I was able to stop a foreclosure of a family's home while in bankruptcy and negotiate a reduction of principal on their mortgage so they were able to keep their home and have an affordable mortgage payment.

What is your firm's point of view regarding clients educating themselves on legal issues?

I believe a client that is an educated one is the best to work with. Not only do they understand what I am saying to them, but they can make more rational decisions if they need to.

Are your attorneys willing to review documents prepared by clients?

In some cases I will allow clients to bring in documents they are submitting themselves either to a bank or to the court free of charge. In some other cases I charge a nominal fee if I believe it will take a while to do so.

Are your attorneys willing to coach clients who want to represent themselves?

My office presently does not have the ability to coach clients who want to represent themselves. I do offer free consultations and clients will take a lot of useful information from that experience if they choose to represent themselves.

Are your attorneys willing to help a client with one discrete part of a case, without taking on the whole case?

I generally will not help a client with one aspect of a case just because if I am the attorney of record on the case this makes me responsible for all aspects, even the parts that clients are handling themselves.

What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?

I am a sole practitioner that does all the work himself from start to finish. My fees are very reasonable compared to other attorneys out there—I know this for a fact. I have clients tell me this all the time!

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

I use alternative dispute resolution whenever I have the chance to do so. Although I usually only see this coming up in a family law situation, but more and more I am using it in the loan modification and foreclosure defense side of my practice.

Does your firm provide pro bono legal services or otherwise participate in your community?

I am an active participant in the Suffolk County Pro Bono Foreclosure project. I attend foreclosure settlement conferences to try to help homeowners who cannot afford an attorney modify their mortgages and stay in their homes.

What distinguishes your law firm from others?

I offer low fee services because my overhead tends to be less than many other firms out there and I am very knowledgeable about the areas of law that I practice. I will answer or return all phone calls within one business day, if not the same day.

Office Hours

Monday through Friday 9:00 until around 7:00, or whenever a client needs me. I also offer Saturday hours on occasion for clients who cannot meet with me during the week. I also offer phone consultations for clients who cannot come to my office to meet with me.

Fixed-Price Services and Fees

Generally for a bankruptcy I charge between $1,000 and $1,500 for a chapter 7. Chapter 13’s are usually $2,000-$2,500 because they are more involved. For a loan modification I charge around $2,000 depending on how complicated it will be. For other services, such as criminal or family court appearances, I offer an hourly rate of between $200-$300 an hour or will sometimes offer a flat fee upon request if the problem calls for it. I will offer a discount if you mention you found me on Nolo.

I offer a free initial consultation for as long as it needs to be.

Typical Retainer

No case is the same but for bankruptcy I charge around $1,000-$1,500 and in some cases I will offer down payments and give the client a payment plan.

Understanding Fees

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the state agency that licenses lawyers upon joining the directory.

Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any state licensing agency.
