We focus on Unpaid Wages litigation, as well as Misclassification, Sexual Harassment, Discrimination, and Wrongful Termination, among others.

Here are two examples of cases the firm has worked on were successfully settled.

$5,500,000 SETTLEMENT- Wage and hour class action (2009). Drivers of White Cap Construction Supply, a company owned by Home Depot, were consistently being denied wages and meal breaks. The case settled only after we aggressively advocated for the class. The parties reached settlement shortly after class certification.

$1,250,000 SETTLEMENT- Wage and hour class action (2009). The hourly employees for Boudin Bakeries, a nationally known bakery based in San Francisco, were being denied their meal and rest breaks.

Just about all of our cases have gone through mediation or some other form of Alternative Dispute Resolution.

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

Collaborative team work is an important policy in this firm. Through delegation of tasks between the attorneys and paralegals, our clients can expect their case to be handled in a cost-effective and time-efficient manner.

Cary Kletter

Cary Kletter is an experienced trial attorney practicing in the areas of employment law, business litigation, civil rights, real estate disputes, and ERISA claims, among others. Mr. Kletter, who has been working for law firms for over fifteen years, was a general litigation associate with the Manhattan law firm of Rosenberg & Estis prior to moving to the Bay Area in 2000. Mr. Kletter has represented individuals, business entities, non-profit organizations and public entities in both Federal and State court.

Mr. Kletter has extensive alternative dispute resolution experience and has represented clients in numerous mediations and arbitrations. He graduated from Brandeis University in June 1992 and obtained a law degree from Hofstra University in May 1995, and also attended Harvard University and Skidmore College. Mr. Kletter is licensed to practice law in the states of California and New York, and numerous federal districts including the Northern and Southern District Courts of California and the Southern and Eastern District Courts of New York. Mr. Kletter is a member of the Bar Association of San Francisco (BASF) and the California Employment Lawyers Association (CELA).

Mr. Kletter has received more than twenty awards for his work as an attorney. In October 2004, Cary Kletter was named Attorney of the Year by the AIDS Legal Referral Panel. In June 2003 he was named the volunteer of the month by the Volunteer Legal Services Program of the Bar Association of San Francisco. He has also received commendations from the California Senate and the U.S. House of Representative.

Sally T. Nguyen

Sally Trung Nguyen is an attorney experienced in representing employees with wage and hour, discrimination, harassment, retaliation, and wrongful termination claims. Ms. Nguyen earned her undergraduate degree from the University of California at Berkeley where she graduated with honors. She obtained her law degree from the University of California, Hastings College of the Law. While at UC Hastings, Ms. Nguyen received an award for her moot court research and writing and was a member of the Employment and Labor Law Association and the Women's Law Journal. She was also a member of the Hastings Negotiation and Mediation Team and won first place at the International Academy of Dispute Resolution Mediation Competition in Chicago, Illinois.

Ms. Nguyen is dedicated to improving the lives of individuals who have been wronged by their employers. She demonstrated her commitment to helping employees by working as a Student Client Counselor at the Hastings Workers' Rights Clinic. Prior to joining Kletter Law Firm, Ms. Nguyen worked at The Armstrong Law Firm in San Francisco, CA where she represented current and former employees in employment disputes. She also worked on multiple employment class action cases during her tenure at various San Francisco law firms.

Ms. Nguyen is conversant in Vietnamese and is a member of the Vietnamese American Bar Association of California (VABANC), California Employment Lawyers Association (CELA), Consumers Attorney of California (CAOC), and the San Francisco Trial Lawyers' Association (SFTLA).

Many employees mistakenly believe that because they are salaried they are not entitled to overtime premium pay. Under both California and Federal law, however, an employee's entitlement to overtime premium pay is in no way determined by whether the employee is paid hourly or on a salary.
