Case Conclusion Date: August 2, 2010 Practice Area: Car / Auto Accident Outcome: Pre-Trial Settlement $95,000.00Description: The Wisconsin Law Journal highlighted a Groth Law Firm, S.C. car accident settlement in Milwaukee County. The case involved a rear end collision where the injured victim's permanent injury was/is tinnitus. The past medical bills were approximately $9,000.00. The settlement totaled $95,000.00 (Ninety Five Thousand and 00/00).

Description: The motor vehicle collision occured on April 6, 2005. State Farm Insurance offered 32,500.00 to settle the claim approximately 20 days before trial. At trial State Farm's Defense Expert Chiropractor stated that any medical care after about 3 months was not related to the collision. Plaintiff's chiropractor and pain doctor opined that her current and future care, pain and problems were related to the collision. The jury found in favor of the Plaintiff with a verdict of $71,000.00.

What is your firm's point of view regarding clients educating themselves on legal issues?

Attorney Groth authored a Personal Injury Blog (www.jonpgroth.com) years ago in order to educate people about their rights. We strongly believe that an educated client is a good client.

Are your attorneys willing to review documents prepared by clients?

Yes. When you first meet with our attorneys we discuss which documents we will need in order to best assist in the handling of their injury claim. We encourage clients to keep a folder of documents that relate in any way to the injury.

Are your attorneys willing to coach clients who want to represent themselves?

Because of the ethical concerns of whether we are the injured person's attorney and whether we would have a duty to draft a complaint or whether attorney client privilege exists we are not willing to coach a client who wants to represent themselves.

Are your attorneys willing to help a client with one discrete part of a case, without taking on the whole case?

We have worked as co-counsel with other attorneys in order to handle a certain aspect of a personal injury claim.

What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?

Because we handle our cases on a contingency basis (no fee unless there is a recovery) it doesn't matter if 2 attorneys are working on the case or 20 attorneys...the client pays the same fee. We put our entire firm behind each case.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

After a lawsuit is filed the vast majority of cases are ordered by the Judge to go to mediation. Again, the vast majority of our in-suit cases settle at or before mediation.

Does your firm provide pro bono legal services or otherwise participate in your community?

Yes. We handle cases for active duty service members. Attorney Nuckels volunteers at the Marquette Volunteer Legal Clinic. We are also active in the Wisconsin Association for Justice as presenters, the State Bar of Wisconsin on various sections and committees and the Board of Directors of the Wisconsin Civil Justice Foundation.
