Firm History
My firm was formed in 1992 for the purpose of helping individuals with legal and financial matters. Our firm acts with integrity and honesty. We maintain a relationship of sincerity and fairness with our clients and dignity in the process. Our specialty is Consumer Bankruptcy, Business Bankruptcy, Chapter 7 and Chapter 13 Bankruptcy, and insolvency matters. Additionally, our highly skilled firm has broad experience in Consumer Credit, Foreclosures, Mortgage Problems, Landlord Tenant matters, General Real Estate, Estate Administration, Personal Injury matters, Litigation, Appeals, Business Corporation matters, and Wills. Bankruptcy clients commonly have other legal difficulties; consequently our extensive knowledge in other areas of the law can be of great help to those thinking about filing bankruptcy.
The initial consultation is always free. At the end of the consultation the client will have a good idea of the best options that are available.
Activities and Awards
I began my law firm in 1992. The firm's practice has always involved Bankruptcy Law Chapters 7, 11 & 13, Civil Litigation, Trial Practice, Motion Practice, Discovery Practice, Appeals, Depositions, Mediation Conferences, Settlement Negotiations, Tort Litigation, Real Estate Practice, Surrogate and Estate Practice, Collection Defense, Landlord — Tenant Practice, and Personal Injury. I have obtained excellent results for clients in wide-ranging matters. In addition, I have for many years provided Legal Counseling through the Bronx Bar Association of which I am a member. I also have much experience outside the law, as an entrepreneur in the computer industry, and as a business consultant for Pfizer, American Express, New Power, and Chase Manhattan Bank.
Example Cases
Consumer Bankruptcies --- Filed dozens of Consumer Bankruptcies relieving clients of burdensome debt and allowing these individuals the chance to start over.
Business Bankruptcies --- In one case, I filed a Chapter 11 Bankruptcy for a corporation that owned a professional building. The bankruptcy filing thwarted a foreclosure proceeding initiated by the bank. In that matter, I filed a companion adversary proceeding whereby my client was able to collect rent from his tenant. Bankruptcy allowed this client time to sell his professional building and obtain profit from the sale. In another case, a business client was allowed to maintain possession of his inventory after chapter 7 bankruptcy and recoup a modest profit from the liquidation of his inventory.
What is your firm's point of view regarding clients educating themselves on legal issues?
In order to best represent our client, it is necessary to obtain as much information as possible from that person. Therefore, it is always beneficial when the client is informed and educated. However, as the attorney, it is my obligation to explain the various alternatives available so that the best assessment is reached and maximum results are achieved. It is also true that the preference of many clients is to have little involvement with the bankruptcy process. For those individuals we offer a secure relaxed environment, and an explanation of the proceedings in simple, clear, and understandable terms.
Are your attorneys willing to review documents prepared by clients?
I am always willing to review documents prepared by our clients. These documents can provide insight into the needs and desires of our clients and can be of great assistance in accomplishing the client’s goals.
Are your attorneys willing to coach clients who want to represent themselves?
A bankruptcy filing is a complex web of schedules, means test questionnaires, tax documents, affirmations and other assorted forms. Many issues can come up which can overwhelm a party not represented by counsel. As a result, I do not believe that coaching a self-represented bankruptcy client helps the client or the attorney.
Are your attorneys willing to help a client with one discrete part of a case, without taking on the whole case?
We would do this only under certain limited circumstances.
What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?
I try to make use of paralegals and administrative assistants wherever possible in order to provide cost effective services.
How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?
In personal injury matters, we sometimes use mediation services to resolve cases.
Does your firm provide pro bono legal services or otherwise participate in your community?
I participate in providing legal referral services through the Bronx Bar Association.
What distinguishes your law firm from others?
I became an attorney, because I have an acute sense of justice and injustice and desired to rectify wrongs. Once an individual becomes my client, it is my desire to advance his or her interest aggressively, but with honesty and integrity. My mission is to help clients attain their goals. Where the client is saddled with overwhelming debt, the goal is to help the client start fresh. In most cases Chapter 7 Bankruptcy allows the client to begin anew with no debt. In some cases, Chapter 13 Bankruptcy can considerably ease the debt load and help the client gain financial control. In matters where the client does not want to file bankruptcy or other extenuating circumstances, I can negotiate with the creditor to largely reduce the client's financial obligations.
