Example cases
We handled an estate where a caregiver had coerced the decedent into transferring certain assets into both of their names jointly. Through litigation and ultimately a trial on these issues, we were able to get an order from the Court requiring the transfer of certain assets back into the name of the Trust and requiring the caregiver to pay our attorney fees.
A group of siblings, all heirs to an estate, came to us because one heir had improperly transferred the family home into her name alone. We filed a lawsuit on behalf of certain heirs. We had a trial to the bench and were able to obtain a judgment based on a constructive trust. The home was returned to the estate and was divided equally among all of the children.

Fees
Our attorneys will be glad to hear some details of your case via e-mail or phone for up to 15 minutes. At that time, they may request that you come in for a consultation or refer you to another firm.
We do offer some fixed rates for Estate Planning, but it ultimately depends on what each client needs. Our personal injury cases are often handled on a contingent basis, with the client only paying for certain case related costs.
Our attorneys hourly fees range from $180 to $295 per hour.

How we can help Estate planning is the area of law dealing with the distribution of an individual's property after their death, taking into account wills, taxes, insurance, property (real and personal) and trusts in order to gain the maximum advantage of the law while still carrying out the person's wishes.

When the case calls for it, we encourage clients to avoid going to court to reduce expenses and trauma.

Benson & Case does community service work — several of our attorneys donate time through the Colorado Bar Association or Law Line 9. Our firm also volunteers together in the community doing work such as the Komen Race for the Cure, Ronald McDonald House and this year a food drive for Project SHARE.

Aaron Evans
He attended college at State University of New York at Oswego, where he received a B.A. in Spanish and Philosophy in 1993. He decided to employ his love of people and problem solving with a law degree. He received his Juris Doctorate from Gonzaga University in 1996.
Admitted to the Colorado Bar Association in 1996, Aaron started his early legal career focused on employment law. He joined Thomas Quentin Benson & Associates in 1997, which then became Benson & Case, LLP in 1998.
Aaron Evans is now a partner in the full service Denver law firm Benson & Case, LLP. After many years of helping his clients with various legal matters, Aaron now takes pleasure in working with the probate, trust administration and estate planning areas, as he gets to help people through a very difficult time after the death of a loved one.
His practice is concentrated on probate and probate litigation; trusts and estates; estate planning; wills; elder law; conservatorships and guardianship; and real estate. He enjoys that he can relate to his clients on a more personal level in dealing with these legal matters.
Mr. Evans is an active member in the Colorado Bar Associations Trust and Estates and Elder Law sections. He is Co-chair of the Rules and Forms committee and is a member of the committee assigned to respond to the Probate Audit Task Group. He is also working on created a new Probate Discovery Rule which will be helpful in dealing with future litigation and keeping attorney fees down for clients.
