Firm Overview

Our firm is designed to serve individuals, families, and small business owners with any legal problems or issues that they may have. I have decades of experience in representing clients in divorce and post-divorce situations, as well as in general civil litigation matters.

Example cases

If I do my job right, most cases will settle without trial. My significant contested cases have dealt with contested custody issues and arguments over entitlement to alimony. In one case, I successfully obtained custody for a mother where the father asserted that she had a history of erratic behavior due to her bipolar disorder. I showed that the condition was under control at the time of the divorce and that she had always been the primary caregiver in any event. In another case, I successfully argued on behalf of the husband that there was no duty to pay alimony where the wife was disabled, but the disability predated the short term marriage.

Fees

Free Initial Consultation?

My standard charge for a legal consult is $250. For that money, I will spend up to an hour with the client and give him or her a "short course" in divorce law. Once I know enough about the client's family and circumstances, I can give an estimate of what I think the cost of the litigation may be. Sometimes I can recommend that the client does not need an attorney and sometimes all the client needs is a good solid briefing on his or her rights.

Services Offered For Fixed Fees?

I charge an hourly rate because in any form of litigation it is not possible to control how much time I will have to send to complete the case. But I am very aware of litigation costs and always try to recommend the least expensive course of conduct in any case.

Hourly Rates

My current billing rate is $295 per hour.

How did your firm decide on the primary area of practice(s)?

I love helping people. I want to be useful. Family law, and divorce law in particular, allows me to be creative is solving problems and to help people who are in the midst of a very difficult and confusing period in their lives.

What is your firm's point of view regarding clients educating themselves on legal issues?

More knowledge is always better than less. However, where there is any issue of significance, either concerning money of the children, it is always best to check with an attorney. Often I have clients who come to see me thinking that the law requires them to submit to an injustice when, with adequate facts and legal analysis, the correct result is not what they expected and they are pleasantly surprised. The application of legal rules most often results in what a client agrees is fair or just, but how the lawyers and court get there may not be readily apparent to a layman.

Is your firm willing to review documents prepared by clients?

I am happy to review documents prepared by a client. If the proposed document is legally adequate to do the job, it saves them money. If I can make recommendations to make it legally adequate, they still save money. Even if it is all wrong, I have in writing what the client wanted to accomplish and my work is then easier, shorter, and less expensive.

Is your firm willing to coach clients who want to represent themselves?

Unless the issue is relatively simple, which it sometimes is, I do not recommend going to court without representation by a lawyer.

Tom Peppler

Marilyn Hochman and I have been practicing together in the greater Oviedo, Florida area for over 10 years. Each of us has over 25 years of legal experience.

I spent six years as an Army officer and aviator before going to law school. I went through Army basic training and initial military specialty training before attending Officer Candidate School. This background gave me exposure to what it is like to be an employee, as well as a manager and leader. I learned that each law and regulation is designed to serve a policy. When the application of the law or regulation does not serve the policy it was designed for, there is almost always a different way of solving the problem, because the wrong regulation or law is being used. My background has made me more creative in my approach to the practice of law.

My strength as a lawyer is based upon my extensive legal knowledge. While I prefer to do family and divorce law, I have handled a wide variety of cases through the years and have developed a special skill in doing legal research. Where some lawyers become sharp by becoming narrow, my broad background makes me better able to think outside the box and to be creative in solving my client's legal problems. My style is to negotiate whenever possible but to be completely aggressive when the other side does not want to be reasonable.

Personal interests:

My under graduate degree was in philosophy. I still like to read, especially the classics, and to discuss and argue about ideas. In addition I have always been interested in endurance sports and am a regular runner and cyclist. Finally, I am a devoted dog lover.
