Example Cases
Car Accidents/Wrongful Death Claim: After drinking alcohol all day in the parking lot of a convenience store, a drunk driver entered the interstate by going northbound in the southbound lanes. The drunk driver collided head-on with another vehicle causing multiple deaths. Our client, the mother of two small children killed in the accident, received over $4 million in settlement.
Truck Wreck: A cement truck was delivering a load to a construction site on I-79, was not paying attention to the traffic pattern, didn't see the stopped cars ahead, and was operating a truck with bad brakes and which was overloaded. The truck skid 104 feet 10 inches uphill rear-ending one vehicle, causing a chain reaction of accidents. Our clients settled for a combined total of $1.75 million.

I have been practicing law for nearly 20 years. During that time I worked for large corporate defense law firms, as well as having been a partner in smaller personal injury law firms. The Miley Legal Group was established in 2006 and is singularly focused on helping clients receive compensation for serious injury or death caused by somebody else's negligence.
We lead clients through the legal maze so they can worry about healing instead of what is going to happen next. We have an aggressive firm committed to providing excellent legal services while keeping clients informed on the status of their case. We focus on our clients' needs, their legal rights and the most effective legal strategy possible.
Previous Employment Summary
I began my legal career as a defense attorney. After experiencing and seeing first hand the tricks insurance companies played on their clients, I realized I was on the wrong side. I quit that field and will only work for individuals that have been injured or killed through no fault of their own.
What is your opinion regarding clients educating themselves on legal issues?
The Miley Legal Group's clients are the types that want to educate themselves and we provide them with as many tools to help as we can. They have a lot of questions regarding the legal process and typically have never found themselves in circumstances like these before. We provide information in all formats: website, hand-outs, books, and videos. We take the concerns of our clients very seriously and want to make sure their questions are answered.
Are you willing to review documents prepared by clients?
We offer a free case evaluation but, because of legal ramifications, will only give legal advice to Miley Legal Group clients.
Are you willing to coach clients who want to represent themselves?
We do not coach clients because of legal ramifications but if they choose to represent themselves (and there are times we encourage victims to try to do that) we will provide them with all of the information that we can, including our free book, links to useful websites, etc.
Why did you decide to be a lawyer?
When I was a child, I admired a local attorney that helped many people in my community. I wanted to be able to help people like he did.
What work experience and education helps you be a better lawyer?
After graduating law school, I worked as a defense lawyer. After experiencing some of the tactics used by insurance companies, I realized my passion was on the side of the victims. I gained firsthand knowledge and experience that serves my clients well. I know the tricks the insurance companies use and I will not let them get away with it on my clients.
Why did you decide on your primary area of practice?
I wanted the focus of my practice to be specific so we would not be distracted by trying to master several different fields of law. I chose personal injury because of the passion I feel in protecting the rights of injured victims.
What do you like best about your career?
The satisfaction of changing someone's life in a positive way after they have experienced catastrophic challenges they could never have anticipated.
We have clients that were providing for their families, working hard, and living life successfully at the time they were injured. Our clients find themselves unable to work due to fractured spines, brain injuries, etc. and having to receive help from their parents/extended family to get by.
We take that horrible experience and fight for them to get the fair compensation they deserve. That is the best feeling in the world and what motivates me and every member of The Miley Legal Group. Our firm makes a positive difference in real people's lives.
Tell us about your law firm:
I have a wonderful staff that offers years of knowledge, experience, and dedication to each person that walks through the door. Our client's team consists of three attorneys, three legal assistants, one client relation manager, one accountant, and one administrative assistant. Each client gets a dedicated attorney and legal assistant assigned specifically to their case but they also have access and the benefit of a collaborative effort from everyone on the team. Our clients get a huge depth of knowledge and experience that is not typical in other law firms.
What are your strengths and style?
My strength is my dedication to stay on the cutting edge of education and technology. I value new and improved ways to help our clients and to pursue all training possible so we can provide the highest quality of service available.
Personal Interests:
I have been honored by being elected to the West Virginia House of Delegates. I represent the 41st District and serve as the Chairman of the House Judiciary Committee. Having the firm, serving in the legislature, and spending time with my wife and stepdaughter, keeps me pretty busy.
