Example Cases
Example Case No. 1: Defense of subcontractor wage & hour claim.
We assisted a small business owner (construction) who had hired an independent sub-contractor to install cabinetry on home remodeling sites. The subcontractor failed to properly document expenses and exhibited poor workmanship. We made reasonable settlement offers then ultimately brought a $24,000 demand down to $8,900.
Example Case No. 2: Client received $20,000.00 cash-for-keys settlement.
We represented a home-owner who entered an oral loan modification agreement with his lender. The lender failed to honor the terms of the agreement and left a substantial amount of funds in a separate account. The lender subsequently failed and was assumed by the FDIC. We were able to recover the funds and obtain an additional $20,000 for the client in a separate agreement with a third-party buyer of his property.

The firm was established by Thomas F. Gallagher in August 2008 after his departure from Barton H. Hegeler, Attorney at Law, APLC, where he focused on Medical Malpractice defense and Professional Liability. Troy Krich, joined the firm in late 2008 while working with Bridge Mediation, LLC with an emphasis on Dispute Resolution and Business Consulting.
Our firm focuses on civil litigation and business law with a target client base of small business owners. We are interested in developing a lasting relationship with our clients on the basis of mutual respect and cooperation from start-up through the growth of the business. We believe that this approach will benefit our clients and our firm by allowing us to grow together. We strive to help our clients make informed decisions, enabling them to avoid conflict and capitalize on opportunities.

What is your opinion regarding clients educating themselves on legal issues?
Our firm encourages the client to educate him or herself on legal issues. This ultimately saves the client money and allows them to understand the steps needed to achieve a desired outcome. Further, the client can appreciate why we are taking a certain position or assist us in locating important relevant documents or identifying key witnesses.
Are you willing to review documents prepared by clients?
We are more than willing to review summaries prepared by clients. At the outset of a case we will often ask the client to prepare a time-line of events leading up to the incident giving rise to their case. This assists us in getting a better understanding of the case from its inception and provides a benefit to the client by reducing the time required for us to familiarize ourselves with their case.
Are you willing to coach clients who want to represent themselves?
Our firm is happy to provide "unbundled" legal services to a client who wishes to represent him or herself. We offer limited scope consultations on a fixed fee basis to allow the client to represent themselves to the extent they can and to avail themselves of our services when they run into problem areas.
Why did you decide to be a lawyer?
I decided to become a lawyer because I have a desire to help people and enjoy finding creative solutions to everyday problems.
What work experience and education helps you be a better lawyer?
I worked as an AmeriCorps volunteer for habitat-for-humanity, helping low-income families achieve home-ownership through "sweat-equity" and community involvement. I believe this experience has taught me a greater sense of compassion for others and the importance of hard work.
Why did you decide on your primary area of practice?
I enjoy working with entrepreneurs because I like to "think like a lawyer," but with an entrepreneurial spirit.
What do you like best about your career?
I like the camaraderie of working with a close friend and the experience working with clients from diverse backgrounds.
Tell us about your law firm:
I work with Troy Krich, a fellow attorney and a law school classmate. We rely on law clerks and a paralegal to increase our case management capabilities and comply with all procedural requirements.
What are your strengths and style?
Cooperative, persuasive, intelligent and creative. I've always had a strong resolve to defend those who find themselves defenseless or have the feeling of being "in over their heads."
