Firm Focus
We are a North Carolina Consumer Law Firm based in Asheville, NC and providing foreclosure defense for North Carolina consumers facing foreclosure. We also have vast experience in assisting NC residents who have purchased defective vehicles, by pursuing remedies under the NC Lemon Law.
Firm History
Established in 2004, by a husband and wife team
Activities and Awards
We perform Pro Bono services through Pisgah Legal Services (Legal Aid) in Asheville, and Jane volunteers at a local consumer counseling center (On Track), donating her time by presenting monthly seminars for first-time home buyers. We have also taught Continuing Legal Education (CLE) on the topic of Foreclosure Defense in North Carolina.
Example Cases
-Stopped a foreclosure in Western North Carolina and negotiated an $39,000 principal reduction and loan modification of the client's mortgage payment from $1,700 a month to $960 a month, and lowered the interest rate from 10% to 2.65%. —Negotiated a $156,000 settlement in a pending lemon law lawsuit for a client who purchased a defective luxury automobile in NC that had engine problems. (These cases are illustrative of matters we handle, but individual results depend on the facts of your case, and prior results do not guarantee a similar outcome.)
What is your firm's point of view regarding clients educating themselves on legal issues?
Information coming soon.
Are your attorneys willing to review documents prepared by clients?
Yes
Are your attorneys willing to coach clients who want to represent themselves?
Yes.
Are your attorneys willing to help a client with one discrete part of a case, without taking on the whole case?
We would decide this on a case by case basis.
What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?
We utilize a staff of certified paralegals, former bank employees, and attorneys to efficiently and effectively handle our client's matters.
How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?
We always seek to resolve disputes before litigating. However, some cases cannot be resolved without filing a lawsuit. In North Carolina, there is mandatory mediation in Superior Court matters, which can be very effective in reaching resolutions.
Does your firm provide pro bono legal services or otherwise participate in your community?
Yes we handle Pro Bono matters. We also provide North Carolina consumers with up to date information on Consumer Laws affecting NC residents at our Facebook page: Facebook Consumer Law Insider
What distinguishes your law firm from others?
Since the collapse of the real estate market, many of our clients began to contact us to help them fight foreclosures. We developed an entire practice area dedicated to protecting the rights of North Carolina homeowners facing foreclosure. There are very few law firms in NC that have such a focus. We have found that many foreclosures are incorrectly filed or lack proper documentation that would enable the lenders to foreclose. There are also many "foreclosure rescue" businesses and self-help information sites in the marketplace that actually harm NC residents, we have found. The Big Banks and Auto Manufacturers are very daunting institutions to the average consumer. We have made it our passion to zealously advocate for NC consumers in their battles with these corporate giants.
