Example Cases

I have handled over 1,000 bankruptcy cases in my career, but one of the most satisfying cases I ever handled was one in which I represented an elderly man and his wife. They were having financial problems, and the man found it hard to come to grips with the fact that he needed to file bankruptcy. He was over 70 years old and, understandably, wanted to make it through life without having to file bankruptcy. However, his business was failing, and there were really no other meaningful options for him. He continued trying to save the business and to avoid bankruptcy, despite my advice. He eventually had a heart attack. Finally, he took my advice and filed bankruptcy. His debts were discharged, and I could see the weight lift from his shoulders. It was very satisfying to see the bankruptcy system save someone's life by eliminating financial stress.

What is your opinion regarding clients educating themselves on legal issues?

I believe clients should understand the legal issues they face. For this reason I write articles on bankruptcy law for Bankruptcy Law Network as well as for my own bankruptcy blog, The Charleston Bankruptcy Blog.

Are you willing to review documents prepared by clients?

All this really depends on the document and the type of case. I welcome client participation in the case and view the attorney-client relationship as a joint effort.

Are you willing to coach clients who want to represent themselves?

I would only recommend that for small claims proceedings.

Why did you decide to be a lawyer?

I like learning the law and using it to help those in need. I chose to represent real people, rather than large corporations. My clients are ordinary folks who need competent legal help with their financial problems.

What work experience and education helps you be a better lawyer?

I have a real-world perspective on representing those with financial problems. I have a wife and three children. I understand financial stress is horrible and can negatively affect a client's marriage, his relationship with his children, and job performance. I've represented ordinary folks with sometimes extraordinary financial problems since 1995.

During law school I worked for Chapter 7 bankruptcy trustee Robert F. Anderson in Columbia, South Carolina. I have also represented bankruptcy trustees during my practice.

Why did you decide on your primary area of practice?

I find bankruptcy law interesting and enjoy helping people with financial problems.

What do you like best about your career?

I enjoy helping people "get their lives back." I know financial problems are stressful, and I enjoy using my knowledge and experience to help people through tough times.

Tell us about your law firm:

I have a top-notch staff consisting of a secretary and paralegal. Both care about my clients very deeply and enjoy their work. They are kind and polite, and clients regularly compliment me on my staff.

What are your strengths and style?

I always try to make clients feel relaxed and at home in my office. I never want them to feel like I am judging them. I always try to match the solutions I offer to the client's unique needs. Also, I do not "sell" bankruptcy. Instead, I try to come up with appropriate solutions--both bankruptcy and non-bankruptcy--to my client's particular needs.

I tend to be very direct with clients. I believe clients appreciate honesty and want to know the truth about their situation.

Personal Interests:

I enjoy spending time with my family. I also like reading, hiking, writing, and skeet shooting.

I am also on the Board to Children in Crisis, a child advocacy center in Summerville. My firm works with a different charity each month at our monthly charity luncheons we host. We do this to give back to our community.
