Previous Employment Summary
Roger D. Wintle, one of the firm's founders began his legal career in Dallas, Texas in 1982 with the law firm of Shank, Irwin and Conant. Mr. Wintle later worked for a branch office of a New York City law firm and eventually moved to California in 1989 where he worked for the San Jose law firm of Ferrari, Alvarez. In 1995, Mr. Wintle started his own law firm and in 2000 Mr. Wintle and four other attorneys formed The Heritage Law Group.

What is your opinion regarding clients educating themselves on legal issues?
I think clients should have some familiarity with any legal issue they are facing. However, I think it is dangerous for a client to become "self-educated" to the point that they feel they can represent themselves in complex legal matters. I subscribe to the adage that oftentimes a client "does not know what they don't know" which results in their making uninformed decisions.
Are you willing to review documents prepared by clients?
I am willing to review documents prepared by clients. My experience is, however, that it takes less time for me to use a document I have used in the past then to try and fix a document prepared by the client. It is more cost effective for a client to engage my services at the beginning, rather than to draft a document found on the internet which oftentimes does not address all of the issues that need to be addressed.
Are you willing to coach clients who want to represent themselves?
I have coached clients in the past and am willing to do so in the future.
Why did you decide to be a lawyer?
I decided to become a lawyer after I was a teacher and head master of a private school. I have always wanted to serve others. I am a problem solver and a pragmatic lawyer and have used my skills as a former educator to both educate my clients and help them solve their problems.
What work experience and education helps you be a better lawyer?
My years of teaching have developed an analytical approach to problem solving. The first thing a lawyer needs to do is analyze the matter brought to him or her by a client. The next step is to explain to the client, in plain English, what my thoughts are and what I plan to do to assist the client. These are skill sets which I developed as a teacher and they serve me well as a lawyer.
Why did you decide on your primary area of practice?
I have always been passionate about real estate, real estate development and the real estate industry. I am currently the attorney for the Santa Clara County Association of Realtors. I also, as noted above, represent numerous brokers and agents as well as businesses in both transactional and litigation related matters.
What do you like best about your career?
My favorite part of my practice is my interaction with my clients and the opportunity to render services which are understandable and affordable. I am a great believer, especially in matters that are heading for litigation or are in litigation, that it is always best to attempt to solve problems before they get out of hand to avoid the cost and aggravation of litigation. I try and get matters in mediation early if they are heading toward litigation are already in litigation to see if the matter can be resolved before all parties become so invested in the amount of money they have paid their lawyers, that it becomes difficult, if not impossible, to resolve the dispute later on.
Tell us about your law firm:
I currently have one associate who works directly with me and an office manager who runs and manages the back office affairs of the office.
What are your strengths and style?
My strengths are my ability to analyze a problem and to effectuate a solution to the problem. i speak to my clients in plain English and explain matters so that the client can make an informed decision. I have a great deal of patience having been a teacher for many years.

I enjoy reading, playing the guitar and traveling with my wife and family.

Typical Retainer
Retainer is based on the type of matter involved. A transactional matter would usually require a $1,500 retainer. A litigation matter would usually be in the range of $5,000.
