Continuing Education

Massachusetts does not require continuing legal education. However I often take classes that are in the field I primarily focus on, especially if the law has changed or is being updated. I also took continuing education courses on the new confidentiality laws.

Example Cases

In a custody case, I fought for a father's rights to gain custody of his three children. It was in the best interest of the children to remain with their father, and he was in a better position to raise the children. Custody was awarded to the father after trial.

In a divorce case there were numerous assets to be divided, most of which were acquired in part prior to the marriage. The wife did not have assets prior to the marriage but wanted an even split of all assets, including those obtained prior to the marriage. The judge evaluated the husband's assets prior to marriage and the equity he acquired during the marriage before dividing the assets. As such the husband received about 80% of the entire estate.

Attorney Nicole Reeves Lavallee has been practicing law for several years in Worcester County. Prior to establishing the law firm of Reeves Lavallee PC, she was a partner in Reeves, Huntoon & Montminy, P.C. Before that Attorney Lavallee has practiced as a general practitioner in a small Worcester law firm, including but not limited to the areas of law, such as domestic relations, probate, estate planning, civil litigation, collections, real estate transfers, landlord/tenant disputes, social security applications, and bankruptcies. She has the experience necessary to litigate any case for which she has been retained.

What is your opinion regarding clients educating themselves on legal issues?

I believe that each client should education themselves to the best of their ability. However, clients also need to understand that the internet is not an ideal resource for education unless they are relying on state specific documents. What is valid in New York may not be valid in Massachusetts so review your sources before relying on them. Speak with your attorney and obtain legal education through them. They have practiced the law and have received extensive training. When in doubt trust your lawyer's advice over anything on the internet.

Are you willing to review documents prepared by clients?

I will certainly review any documents prepared by the client. However, on occasion it may be beneficial to just have the documents prepared by the attorney.

Are you willing to coach clients who want to represent themselves?

I can represent a client in limited assistance capacity, which means that if a client only needs assistance with one court appearance or discovery I can do so. I can also just limit my representation to advice so the costs can remain minimal and they can still receive quality representation.

Why did you decide to be a lawyer?

I wanted to help people who could not do so for themselves. It brings me great joy to help others in their time of need, no matter what type of case it may be.

What work experience and education helps you be a better lawyer?

I am a person of honor and integrity and I believe that this country is built on laws that benefit all areas of our lives. I think that if you have the persona of character centered around family life, no matter what your family dynamics are (married, divorced, separated, single parents, etc.) then you can triumph.

Why did you decide on your primary area of practice?

Children are our future and they need to grow up in safe and healthy environment. In family law, I get to mold those children through their parents' actions and inactions. I often show the parents a better way to interact with their spouse, former spouse, former partner, or former relationships.

What do you like best about your career?

Seeing pictures of the children I am helping and through the years getting updates and photos as they grow older. I also like building friendships with my clients.

Tell us about your law firm:

I am a solo practitioner so I return telephone calls promptly and often answer the telephone myself. My paralegal has been working for me for several years and is very familiar with the needs of the clients and will respond promptly to any issues as they arise.

What are your strengths and style?

I am passionate about my client's rights and helping them to gain the right direction, through legal assistance, so that they can benefit in their individual needs. My business thrives on my character and the bottom line is not necessarily the dollar bill.

I have a fixed fee for certain types of cases such as drafting of a simple will ($250), power of attorney ($100), health care proxy ($50), real estate transaction ($600), declaration of homestead ($40), or uncontested 1A divorce ($1,700). I can review the documents if they are already prepared for a flat fee as well. Discounts are available if you found me on Nolo and mention it during our initial meeting.

Typical Retainer

Yes, the retainer would be based on type (civil, custody and divorce, asset divorce, etc) of case. The average retainer for a custody dispute is generally between $4,500 and $7,000; and the average retainer for an asset dispute is generally between $3,500 and $6,500.

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the state agency that licenses lawyers upon joining the directory.
