Preferred New Clients
Most of our clients are couples or families who have realized they need to plan for the future to be sure a spouse and children are cared for, and mature couples with significant assets who want to plan to reduce or avoid estate taxes. We also handle post-death trust administration, and probate estates if there is no trust. Some clients need only a health care directive or financial power of attorney, or need a review and update of existing estate plans, including trust amendments and will changes.

Example Cases
We created a comprehensive trust plan for an entrepreneur who died leaving millions to his spouse and children, and saved the family $750,000 in estate taxes that went to the spouse and children rather than the IRS.
We probated the estate of a man who died in 1985 with no will or trust, leaving heirs in several states, some living in his house. 20 years after he died the heirs wanted to sell his residence and discovered they did not own it yet because there had been no probate. The executor lived in another state and contacted us to handle the probate. We oversaw repairs to the property that greatly increased the value, arranged sale of the property, successfully negotiated with the county over property tax increases, sued a buyer who reneged on a purchase agreement, and finally were able to distribute substantial money to the heirs.

Firm Focus and History
We probate the estates of persons who pass without a trust, or administer the estates of persons who have a trust. The other primary focus is estate planning. We meet extensively with our clients to determine what their specific needs are. Once we know the clients' situation and desires we evaluate what options will achieve their goals and prepare an estate plan that suits those needs. The goal is to give the client confidence that they have prudently planned for the future. We serve people from San Jose to Santa Rosa and all points between from our Oakland location.
My wife Marlene Fong and I have worked together as attorneys since 1985. We formed our own firm in Oakland/Alameda in 1998 as an estate planning practice, helping clients plan for their futures and avoid problems with inheritances and taxes.
Previous Employment Summary
By choice, my career as a lawyer has always been with small firms, first in Oakland from 1979 to 1985 involving people injured by dangerous products, then from 1985 to 1998 representing home owners saddled with leaking and poorly built homes, forcing the builders to make repairs. Starting in 1998 Marlene and I have worked together in our own practice, Scholtes and Fong, planning wills and trusts for families and individuals, then guiding the process of distribution after a death.

Domestic Violence Clinic volunteer, Alameda County Superior Court; Guardianship Clinic volunteer, Alameda County Superior Court; counseling seniors and disabled persons at Legal Assistance for Seniors on health care insurance and Medicare issues; fundraising for Leukemia and Lymphoma Society.
What is your opinion regarding clients educating themselves on legal issues?
I encourage clients to educate themselves about the issues so we can hit the ground running when they come to me for the lawyer stuff. There are wonderful online sources like Nolo, Cornell and others with reliable and easy to understand information about estate planning, probate, trusts, and other related subjects. I am not at all threatened by the educated client, so long as they let me do the law part and listen to my advice.
Are you willing to review documents prepared by clients?
If a person is already a client and has some self-generated documents I will review them, but this is very rare. I can't take the risk of giving advice to self-represented people, however, since I have no control over the final product but could get blamed for problems in the papers or handling of the case. Plus, my actual clients take up 100% of my time already and I can't short-change them by giving attention to do-it-yourself-ers.
Are you willing to coach clients who want to represent themselves?
I really cannot coach self represented people, who could create problems I could be blamed for later. In fact this has never come up in my practice.
Why did you decide to be a lawyer?
Actually I wanted to be a teacher. So did Marlene, who taught high school English before becoming a lawyer. But professorships were hard to come by in 1976 so I did the next best thing. I enjoy the intellectual challenge, the constant learning of new things, the ability to use reason and logic to persuade. But most of all I wanted to make a difference in people's lives.
What work experience and education helps you be a better lawyer?
I've been a cannery worker, forklift driver, Sears hardware salesman, and a lot of other things that give me some perspective on life. Thirty-one years' experience as an attorney also gives me some perspective on how to effectively represent clients. Having a young daughter in school and being homeowners in Alameda puts me and Marlene in touch with the community in a very personal way. We have a large stake in the success of our town, region and culture.
Why did you decide on your primary area of practice?
Estate planning practice is ideal for the small firm or partnership where the client needs the reassurance of ready access to the attorney, and where the attorney wants the direct contact with clients. I like the personal contact with individuals, and like to see the result of our work in the peace of mind it brings to clients.
What do you like best about your career?
Most of all I like the results of what we do. Helping people plan for their futures, and for their children's' futures, and seeing the harmony and peace that comes from a well thought out estate plan, gives me great satisfaction. I also take pride in untangling or averting family disputes, especially after someone has died and assets are to be divided. The job of the estate planner is anticipating problems and planning to avoid them.
Tell us about your law firm:
Marlene Fong and I do all the legal work, from taking the initial call from a possible client, to the client meeting to gather information, and planning for the client. We consult with each other on all our cases, which we believe produces a better final product for the client.
What are your strengths and style?
We are easy to talk to and not at all intimidating. We know that a person calling us may never have talked to a lawyer before and now is revealing personal facts about their lives. We are informal and encourage clients to be open with us as they would be with friends or family. Clients have our cell phone numbers and can reach us seven days a week if need be. We pride ourselves on making the process as easy as possible.
Personal Interests:
Spending time with our daughter and her activities, reading, gardening, riding bicycles, trying to keep up with our Brittany puppy on walks.

Fixed-Price Services and Fees
Our flat rate for preparing a trust package with the entire accessory documents including power of attorney, health care directive, pourover will, and others, is $1500. We offer payment plans, installment plans, and give a substantial discount to AARP members and clients who come to us through NOLO. Trust amendments are normally done on an hourly basis, with a not-to-exceed agreement in advance. Probate fees are set by statute and approved by the court, and vary in each case depending on the value of the estate assets.

Typical Retainer
For trusts we normally take a 50% down payment when hired. In other kinds of cases we may require a retainer if litigation is likely or where the project is open-ended and not suitable for a flat-rate fee arrangement. If court filing fees are needed we require the client to pay those up front.
Nolo's Licensing Check
Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the state agency that licenses lawyers upon joining the directory.
Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any state licensing agency.
