Maurice Recchia is a trial lawyer and litigator with more than 15 years' experience as an insurance defense attorney. He has tried approximately 50 cases to a jury verdict in State and Federal court in New York City and the lower Hudson Valley. He has taken hundreds of depositions. He is also a successful appellate litigator and has written and argued several appeals including Laracuente v. Ruiz 758 N.Y.S. 2d 641 (1st Dept. 2003), Joyce v. Manhattan College et. al. 767 N.Y.S. 2d 216 (1st Dept. 2003), Serrano v. Republic Insurance et. al. 48 A.D. 3d 665 (2nd Dept. 2008), Barret v. Watkins 82 A.D. 2d 1569 (3rd Dept. 2011), Kranis v. Biederbeck 83 A.D. 3d 903 (2nd. Dept. 2011).
Mr. Recchia has been a paralegal instructor and for 2 years taught the law of New York torts to paralegal students in Manhattan.
Mr. Recchia enjoys providing all of his clients with free & open communication with him and he gives his clients clear explanations of the lawsuit process — he dislikes "legalese" and instead provides straight talk in plain English. He returns client phone calls promptly; if he can't return a call on the same day because he's in court, he'll return it the very next day. What is your firm's point of view regarding clients educating themselves on legal issues?

I am happy for clients to educate themselves on legal issues by reading personal injury websites & other legal materials. I always do my best to explain how the legal system and lawsuit process works both to my clients and to prospective clients who call for a free consultation.

No, this is not a service we offer.

Are your attorneys willing to coach clients who want to represent themselves?

No, this is problematic and could create a situation where we created an attorney-client relationship without having entered into a proper legal services agreement. I do offer recommendations to prospect callers who call for a free consultation if it appears that an action in small claims court may be the way to resolve their issues.

No, again this could create an attorney-client relationship without a proper legal services agreement.

What are your policies about dividing work among the firm's partners, associates, and paralegals to make the process most cost-effective for the client?

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

Anytime it is appropriate in a case. As a trial attorney, I always prepare each client's case as if it will go to trial. If the other side wishes to try to resolve the case before a trial, I am always open to these alternatives. Usually, properly preparing a case for success at trial has a positive effect and getting an appropriate resolution before a trial is necessary.

Does your firm provide pro bono legal services or otherwise participate in your community?

I do provide pro bono help to Catholic Charities in appropriate situations where I can provide help or advice. I am freely available to give speeches to community groups on personal injury topics without a speaking fee anytime a group needs or would like a speaker for their meeting.

What distinguishes your law firm from others?

My commitment to free and open communication with my clients. I always take the time to explain the lawsuit process to my clients, how much time it will take, what they can expect from their lawsuit, and how they should prepare appropriately during each phase of their lawsuit. I explain things in plain clear English so my clients can understand what is going on. I am freely available to my clients during business hours by phone and I provide my mobile phone to clients to use in emergencies. I provide my clients with regular updates on their case, answer their phone calls promptly, and always keep them informed about any settlement offers or discussions.
I enjoy being able to use my education, skill & experience in fighting for "the little guy" against the big corporate insurance companies.

Typical Retainer

Standard 1/3 contingency fee agreement. Client does not pay any legal fees unless and until there is a monetary recovery by pre-trial settlement or verdict after trial. Then client pays 1/3 of any settlement or verdict as the legal fee plus expenses.
