The Law Office of John Merchant specializes in providing professional legal service to individuals and growing businesses. We research and analyze prior art, prepare and prosecute U.S. patents, trademarks and copyrights, and draft contracts and licensing documents aimed at preserving intellectual property assets. We also assist business clients on a variety of general business law matters. Established in March of 2007.
Previous Employment Summary
I have been practicing in the Bay Area since 1992. Prior to establishing this firm, I worked as patent and trademark prosecutor in Silicon Valley and San Francisco and as a civil litigator in Oakland. I have significant experience in a variety of legal matters including intellectual property, construction, employment, corporate contract and other business law matters.

In addition to my regular practice, I perform pro bono work for various nonprofit organizations.
What is your opinion regarding clients educating themselves on legal issues?
I encourage clients to educate themselves on all legal issues which are relevant to their artistic, business, and entrepreneurial concerns. And I try to assist clients in the learning process. Clients who understand legal issues are more likely to make sound business decisions.
Are you willing to review documents prepared by clients?
I appreciate clients who want to be involved in the preparation of legal documents, and I am open to reviewing client prepared documents. Our aim is to provide quality legal service and assist clients in achieving their goals.
Are you willing to coach clients who want to represent themselves?
As professional legal service providers, we aim to serve clients in their best interest regarding their legal matters. We will assist clients who want to represent themselves.
Why did you decide to be a lawyer?
I decided to become a lawyer out of personal interest in the law and a desire to help people.
What work experience and education helps you be a better lawyer?
I have significant experience working with both technical and non-technical clients on a variety of legal issues including litigation and transactional matters. It is my central role as legal counsel to be as knowledgeable as possible about the legal aspects of each matter, and that is why I have an advanced legal degree in intellectual property law. My background in basic science and my experience in the law also help make me an effective translator of technical issues.
Why did you decide on your primary area of practice?
I feel especially rewarded working on creative entrepreneurial projects. I enjoy meeting enthusiastic people and I enjoy being a part of the creative process.
What do you like best about your career?
I meet many creative, caring and interesting people through my work in intellectual property law.
Tell us about your law firm:
I enjoy working directly with clients on all matters, but the firm isn't just me. I also employ consultants and assistants when appropriate to help maintain a high standard of service.
What are your strengths and style?
I'm a good listener and communicator. I can translate difficult technical concepts into layman's terms. I try to maintain a professional and friendly style. I am open and honest and I try to do my very best for each client.
Personal Interests:
I am personally interested in new design concepts, practical innovation and the creative process. I often spend my time away from work in the outdoors. I love to play tennis, surf and play music with friends and family.

We provide some services on a fixed fee or capped fee basis depending on various factor including what makes the best financial sense for the client.
Hourly Rates
My hourly rates range from $150 to $250 per hour depending on the type and difficulty of the matter or project.
Free Initial Consultation?
We do not charge for initial consultations. We make sure that we have a firm understanding with the client about the scope, costs and fees associated with any project.
Typical Retainer
We ask that the client deposit funds in trust to cover anticipated initial costs and fees associated with a matter. We try to be very upfront with our clients regarding anticipated costs and fees so that the clients know what to expect and budget. If clients know what to expect, they are usually happy to pay the fees, and this allows us to maintain a reasonable fee structure.
Nolo's Licensing Check
Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the state agency that licenses lawyers upon joining the directory.
Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any state licensing agency.
