Firm Focus and History

We are a general practice firm with emphasis on litigation and trial work. The bulk of our work for the past several years has been in negligence defense work, including numerous successful trials. We have recently been handling more plaintiff negligence claims. In the past, we have done a great deal of criminal defense work. Now, we handle more civil matters, including insurance law. We handle wills, probate, contract disputes, DWI defense, small claims matters, consumer disputes and collections. We have also defended debtors.

We have perfected numerous appeals in connection with our negligence defense cases and have succeeded in getting many favorable verdicts upheld.

Our firm was established in 1989 when I left a small law firm which limited its practice to negligence defense. I joined my wife, Jo Anne Leegant, who had established a general practice firm several years earlier. I brought in a large insurance company as a client and the firm evolved to the point where negligence defense still constitutes a substantial portion of the practice.

Previous Employment Summary

My first job after law school was as an assistant county attorney for Erie County (Buffalo, NY). My first legal argument was made at the New York State Court of Appeals two days after I was admitted to practice. Most of my time as an assistant county attorney was spent prosecuting child abuse cases and juvenile delinquents in Erie County Family Court.

In 1984, we relocated to Rochester, New York, where I worked for a general practice firm which primarily emphasized plaintiff's negligence work. I managed a legal services plan for the UAW, which concentrated on consumer law. My last employment before joining my wife was at a negligence defense firm, where I was the principal trial attorney. My primary focus has always been on trial work. My reputation in the legal community was honed by many years of hard work.

Activities and Awards

I have served as a mock trial judge and also as a coach for two local high school mock trial teams. My teams have won regional championships and gone on to compete for the statewide championship in Albany.

What is your opinion regarding clients educating themselves on legal issues?

A client who is willing and able to educate himself on legal issues is far better equipped to assist his attorney in representing him than a client who is unaware of what issues are important. Knowledge and preparation are essential to quality legal representation. Many a good case has been lost because a client neglected to inform his attorney of an important fact which was later raised by the opposing attorney at trial. Every case we take gets the full attention it deserves.

Are you willing to review documents prepared by clients?

I am always willing to review documents prepared by my clients. The more information I have about a legal matter, the better I can do my job and the more accurate the advice I can give.

Are you willing to coach clients who want to represent themselves?

There are some arenas, such as New York State Supreme Court civil trials or criminal trials, in which no client, not even another attorney, should represent himself. However, there are other areas, such as small claims, minor traffic violations and certain Family Court proceedings in which a client can successfully represent himself. Sometimes a pro se answer is appropriate in a lawsuit in order to prevent a default judgment. In appropriate cases, I am willing to coach and assist such clients. The client always makes the ultimate decisions.

Why did you decide to be a lawyer?

Life is complex and frequently unfair. Practicing law has given me the opportunity to help ordinary people achieve at least some fairness and justice in life. People falsely accused need a champion, just as do victims. Persons hurt as the result of someone else's negligence deserve to be fairly compensated. Helping these people makes me proud of what I do.

What work experience and education helps you be a better lawyer?

I got my first job in a shoeshine parlor at the age of nine. I have worked as a gandy dancer on the railroad, changed diapers on the night shift at a nursing home, worked construction, served in the U.S. Army Infantry, worked the grill in a diner and have never been unemployed more than one week. You can't understand ordinary people's lives and represent their needs and desires if you have never shared their experiences.

Why did you decide on your primary area of practice?

I didn't plan to be a trial lawyer. I chose my areas of practice when I discovered how much I enjoy trial work and how successful hard work and experience have made me.

What do you like best about your career?

I was recently approached at a mall by a person I had successfully defended almost 20 years ago on a DWI charge that would have ended his career as an over-the-road trucker. The thanks and appreciation of people like him is the primary reason I love my work.

Tell us about your law firm:

My wife is my law partner with over 25 years experience, so all of our clients are personally served by one of the senior partners. Although each of us maintains our own files, we are familiar with each other's files and are able to substitute for each other at a court appearance, or even at a trial in the event of a conflict. Clients who hire us never have their important matters pawned off on junior associates to get some OJT at the client's expense.

Our two legal assistants have been with us for many years. They both truly care about our clients' problems and they develop positive working relationships with them. They are always willing and able to answer non-legal questions and to provide support and empathy to our clients.

Since many of our clients are defendants in civil lawsuits, they require such support. Nobody wants to be sued and it is difficult for a client not to take it personally when he or she is served with a summons and complaint. On the other hand, our personal injury plaintiffs have sustained physical injuries and also need reassurance and support, as do our criminal clients. This may be the one lawsuit the client has in his or her lifetime, and that's something we never forget.

What are your strengths and style?

I am able to identify the relevant issues and limit my focus to those issues. A scattergun attack or "everyone and everything" approach is for television shows and rookies. I have tried numerous cases and have developed a great deal of skill in that area. My questioning on direct and cross examination at trial is concise, incisive, laser-focused and effective. Jurors have told me that they appreciate this, as I am able to make my points clearly and succinctly. I have been told that I am especially skilled at cross examining witnesses. Because of my early experience in Family Court, when I was required to conduct trials with no preparation whatsoever, I developed the ability to think on my feet and to respond swiftly when confronted by the unexpected. I am able to prepare for trials and organize my thoughts so that I can conduct trials seemingly off the cuff, which is intimidating to my opponents. If you out-work, out-prepare and are better and more experienced than the opposing attorney, you usually win.

Personal Interests:

I am an avid bridge player. I enjoy doing crossword puzzles and always have several Sunday New York Times puzzles in my briefcase which I work on while I am waiting at the courthouse. I am an animal lover and we share our home with 3 cats and 2 retired racing greyhounds. I enjoy cooking and am the chef at home. Ribs in the smoker and a glass of good wine are the stuff of life.

We generally charge fixed fees for criminal, DWI and traffic matters and charge an hourly rate for everything else. We are flexible and would definitely consider offering a discount for Nolo clients. We would be willing to waive any initial consultation fee for Nolo clients.

Free Initial Consultation?

We always offer a free initial consultation to prospective personal injury clients. In other matters, we will apply any fee paid for the initial consultation to the retainer and/or hourly fee. For most matters, Nolo clients receive a free initial consultation.

The retainer depends upon the specific legal matter and our estimate of the amount of time required to complete the work. We believe that a client should always know how much our representation on any matter will cost. Communication and mutual trust are essential to a successful attorney - client relationship.
