Failure to properly manage labor and delivery ? prolonged fetal distress resulting in brain damage. This case was against five labor and delivery nurses, two Board Certified obstetricians, and one second year obstetrical resident who failed to notice fetal distress over the course of more than 12 hours, and failed to order a timely emergency c-section. This case was settled one week before trial was set to begin for $6,000,000. This is the largest settlement recorded in Massachusetts.
Gath, et al. v. M/A-COM, et al. MICB1998-6221
Traumatic Brain Injury caused by a faulty gate. This case results from an unlatched gate swinging out into the road and striking Mr. Gath resulting in permanent brain injury. A jury awarded Mr. Gath $14.2 million plus interest (~$24million), which was upheld by the SJC and collected by Mr. Gath. In 2010 dollars, an equivalent award would be more than $28million. This is the largest amount ever collected by an individual in Massachusetts.
