Continuing Education

Each year I easily exceed the number of legal continuing education hours required by the Massachusetts Bar. I attend legal conferences annually with both the American Association for Justice and the Massachusetts Academy of Trial Attorneys, in addition to day seminars which are offered by Massachusetts Continuing Legal Education.

In June 2010, I attended the Annual Delegation of the Pan-European Organization of Personal Injury Lawyers in Geneva, Switzerland where interesting topics included how different countries handle medical malpractice cases. Furthermore, I attend, when my schedule permits, the Boston University Genetics and Obstetrics/Gynecology Annual Convention where I receive a unique view of how doctors throughout the country respond to malpractice incidences. This conference has enabled me to make some truly beneficial relationships with expert doctors throughout the country who are willing to work on behalf of a medical malpractice plaintiff.

5. Hanks, et al. v. Klein, MD, et al. WOCV2003-02240A
Failure to properly manage labor and delivery ? prolonged fetal distress resulting in brain damage. This case was against five labor and delivery nurses, two Board Certified obstetricians, and one second year obstetrical resident who failed to notice fetal distress over the course of more than 12 hours, and failed to order a timely emergency c-section. This case was settled one week before trial was set to begin for $6,000,000. This is the largest settlement recorded in Massachusetts.

Gath, et al. v. M/A-COM, et al. MICB1998-6221
Traumatic Brain Injury caused by a faulty gate. This case results from an unlatched gate swinging out into the road and striking Mr. Gath resulting in permanent brain injury. A jury awarded Mr. Gath $14.2 million plus interest (~$24million), which was upheld by the SJC and collected by Mr. Gath. In 2010 dollars, an equivalent award would be more than $28million. This is the largest amount ever collected by an individual in Massachusetts.

What is your opinion regarding clients educating themselves on legal issues?

I feel that it is fine for a client to educate themselves on legal issues; however there is no substitute for an attorney's expertise and experience in analyzing complex legal issues and case law.

I am willing to review documents prepared by clients so long as they are not legal in nature.

I am unwilling to coach a client who wishes to represent themselves.

Why did you decide to be a lawyer?

I decided to become a lawyer so that I could help the oppressed and wronged.

What work experience and education helps you be a better lawyer?

I have 30 years experience helping people and I believe that that helps me be a better lawyer.

Why did you decide on your primary area of practice?

I chose my area of primary practice because I have, and still do, make a difference.

What do you like best about your career?

My favorite thing about my career is that I am still doing it.

My daughter is running the office and I have a very smart associate with another to join. We are surrounded by law students.

I believe myself to be forceful and reflective.
