Example Cases
• All information regarding our clients, including their identities is strictly confidential. An illustrative case (changing the names of the parties) is a divorce between Harvey and Wilma (H and W hereafter). W wants to move to Nova Scotia to live with her family and H lives in the Bay Area working for a software company. W files a Domestic Violence Restraining Order against H. W accuses H of spousal battery and child abuse. I represented H. When H came to see me, he denied any acts of violence or abuse. W provided no physical evidence of abuse, no police report and no medical records supporting any domestic violence. It was my opinion that W's claims were false and designed to get a leg up in the divorce process (should the Court find that H perpetrated an act of domestic violence, he would have been precluded from having sole or joint custody of his children and W would have had an easier time getting the court's permission to move with the children). We defeated the domestic violence allegations at trial and H was ultimately given primary custody of the children.
• Another typical case is the situation where I was hired by one side of a divorce and the other side was represented by an attorney. As soon as I was retained, I contacted the other attorney and immediately put that case into settlement conference mode. At an initial meeting we were able to identify the problems and with the other attorney develop a plan to exchange additional information. We agreed to meet several weeks later where we were able to put together a complete and mutually beneficial settlement agreement related to dividing the parties several homes, stock options, and retirement plans. We also developed a long-term custodial plan for the parties 2 middle-school aged children, and settled both child and spousal support.
• A renter was two months late in paying rent. We filed an unlawful detainer, which was granted and were able to have the sheriff escort the non-paying tenant out of the premises.

The Law Offices of David M. Lederman were established in 1998 in Walnut Creek, CA. In 2006, it expanded to a second office in Antioch, CA. I have successfully handled numerous child custody cases involving disputed interstate jurisdictions, as well as the Hague Convention cases. I am a Certified Specialist in Family, certified by the State Bar of California Board of Legal Specialization and am one of only a few attorneys in Contra Costa County to have earned that distinction. I also speak Mandarin Chinese. I am a member of the Board of Directors of the Contra Costa County Bar Association's Family Law Section and served as section president in 2008.

Lederman sponsors a bimonthly pro per family law clinic for the Contra Costa Bar Association; I am a member of the Contra Costa Bar Association, Family Law Section Board of Directors, and I have taught numerous classes and seminars to attorneys through the Contra Costa Bar Association and the National Business Institute.
What is your opinion regarding clients educating themselves on legal issues?
We strongly encourage our clients to education themselves and actually spend a significant portion of our time educating clients about legal issues and the long-term impact of their decisions. There are many fabulous self-help and educational resources available such as the Nolo website, and the courts' web. Our firm website www.ledermanlaw.net has significant self-help resources and links as well.
Are you willing to review documents prepared by clients?
We review documents prepared by self-represented clients on a weekly basis. Not everybody needs, or can afford full-service legal representation. Sometimes a client just needs guidance and we can provide that guidance. We can review documents and make recommendations to improve the documents prepared by self-represented litigants.
Are you willing to coach clients who want to represent themselves?
We provide what is called unbundled services. A client can hire us to review a document or documents, appear for the limited purpose of a hearing or even a trial. I have had clients consult with me on an ad hoc basis in preparing a discovery plan (methods to obtain documents) and to advise on pre-trial procedure and then hire us for the limited scope of presenting the case at trial. I have served as the Unbundled Legal Services Committee Chair for the Family Law Section of the Contra Costa County Bar Association.
Why did you decide to be a lawyer?
When I was younger, I recall that the show stopper to an argument was "the law says x." I did not like not knowing what my rights and obligations were in society so I decided to learn. When I started studying law, I realized that I thoroughly enjoyed the subject matter and was quite good at trial advocacy (I excelled in moot court and had the honor of arguing closing arguments in front of the then California Supreme Court Chief Justice Stanley Mosk, now deceased).
What work experience and education helps you be a better lawyer?
Oddly enough, much of what makes me a better lawyer comes from martial arts. Over the course of my life I’ve studied Chinese Kungfu (Praying Mantis style), Tai Chi, Qi Gong, Isshinryu Karate, and Jujitsu. I learned to relax and recognized that by relaxing I could move faster and hit harder. I learned to maintain balance and objectivity and most importantly to control my emotions. While my clients may be going through one of the hardest experiences in their lives, I remain calm and objective so that I can advise them and advocate for them. It is not infrequent that I must remind another attorney to focus on the data and maintain their objectivity.
Why did you decide on your primary area of practice?
I wanted to deal with individuals, not intuitions. I discovered that my objectivity is more valuable in family law and real estate where people tend to act or react emotionally.
What do you like best about your career?
What I like best about practicing law is the collegiality of the bench (judges) and bar (other attorneys), I like negotiating an advantageous settlement or competing against a competent adversary at trial.
Tell us about your law firm:
I personally ensure that my staff is well trained, competent and pleasant to all of our clients. I directly handle all of the hearings, trials, and negotiations. I am supported by an outstanding staff. My associate does much of the drafting and serves as my back-up. My paralegals are continually trained and are attentive to all our clients' needs. My administrative staff is a client's first point of contact with the firm, and they manage the back office operations.

Hard work ethic, compassion, and Spartan objectivity.

Hourly Rates
Our attorney rates vary from between $275 for my associate and $350 for me.
Free Initial Consultation?
Our initial consultation is $250 for about an hour and we apply that $250 towards the deposit against future services (essentially creating a free initial consultation).
Typical Retainer
For family law matters a typical retainer would be $4,000 to $8,000, but it could be significantly more or less based on the complexity of the case.
Nolo's Licensing Check
Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the state agency that licenses lawyers upon joining the directory.
Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any state licensing agency.
