Example Cases

I recently reduced a Chapter 11 Client's secured debt by over 90%, and the managing members maintained total control of the reorganized debtor. Unsecured debt was reduced by 60%, and refinanced over a term of five years. The Debtor never closed its doors, and exited bankruptcy as a far more profitable entity.

In a recent Chapter 13 case, the Debtor's logging equipment was at risk of repossession. The business was not producing income due to depressed timber prices. The Debtors were able to refinance their business equipment and personal vehicles through the Chapter 13 plan, and were able to stay in business while the economy rebounded.

Firm Focus and History

The focus of my practice is the client's desired result. I communicate realistic expectations, estimated costs and the status of their cases on a regular basis. Neither the type of the case or the fees being paid play any role in how I treat my clients. I hold myself and my legal products to the highest standards.

The Law Offices of Benjamin C. Tiller was formed to satisfy my dream of someday owning my own practice. After choosing Western Montana as the perfect place to live and raise a family, I opened my doors shortly after gaining admittance to the State Bar of Montana.

Previous Employment Summary

Before law school, I joined the Americorps program Teach for America. Through this program, I taught 7th and 8th grade math in Greater New Orleans. I clerked for a veteran attorney in Oregon during law school. His practice focused on family law, Social Security Benefits and Criminal Defense. After law school, I spent a year coaching lacrosse at the University of Oregon and planning my firm.

What is your opinion regarding clients educating themselves on legal issues?

The best clients are those who have an understanding of the law, but still seek advice when they need additional guidance. These relationships are always productive, and the foundational experience of these clients helps expedite the process, resulting in fewer billed hours.

Are you willing to review documents prepared by clients?

I will gladly review documents for clients at my hourly rate. I do require that clients sign a fee agreement that limits the scope of my representation.

Are you willing to coach clients who want to represent themselves?

I will coach clients on specific questions, presented in writing, at my hourly rate. A signed fee agreement limiting the scope of this type of representation is required before any help will be given.

Why did you decide to be a lawyer?

I became a lawyer to help people find productive solutions to their problems while satisfying a constant urge to challenge my mind.

What work experience and education helps you be a better lawyer?

My experiences as a teacher in New Orleans taught me to communicate effectively and respectfully with people from a broad range of demographic backgrounds. Coaching lacrosse during and after law school also taught me to be a master of time management, meticulous with my calendars, and efficient in everything I do.

Why did you decide on your primary area of practice?

I became interested in bankruptcy law while at the University of Oregon. I had an inspiring professor (Andrea Coles-Bjerre) from whom I took every course she offered on the subject.

What do you like best about your career?

I wake up every morning, look at my calendar and say to myself 'who do I get to help today.' This is what keeps me coming back.

Tell us about your law firm:

I am a true solo practitioner. I answer and return all of my calls, and handle all of my scheduling. I am able to quickly build strong relationships with my clients this way, and I stay constantly up to date on their needs.

What are your strengths and style?

My greatest strength as an attorney is my ability to listen to my clients' needs. I also see this as my greatest role. I prefer direct communication with clients, and always clearly set forth whether their expectations are reasonable. I try to keep my clients from thinking 'what's going on with my case,' but if they do ever reach that point I truly appreciate their call.

Personal Interests:

I spend my time away from my practice with my beautiful family or participating in a number of outdoor pursuits. These include bowhunting big game, hunting upland birds, flyfishing and training my two German Shorthaired Pointers, Jake and Jupiter.

Fixed-Price Services and Fees

Personal injury cases are handled on a contingency fee basis. If you do not get paid, I do not get paid.

I do offer some services at a fixed rate. A basic Chapter 7 begins at $1350. Chapter 13 bankruptcies are priced at a flat fee of $3,500.00. Only in extraordinary cases will the fee be higher than the flat fee (which has only happened once).

Hourly Rates

Personal injury cases are handled on a contingency fee basis.

My basic hourly rate is $135 for all other matters, and I generally require a $2,500 retainer.
